Motor Traffic (Cabs – Fares and Charges) (Jersey) Order 2017

THE MINISTER FOR INFRASTRUCTURE, in pursuance of Articles 38 and 46 of the Motor Traffic (Jersey) Law 1935, orders as follows –

1        Interpretation[1]

In this Order, unless the context otherwise requires –

“bank holiday” has the same meaning as in the Public Holidays and Bank Holidays (Jersey) Law 1951;

cab” means a taxi-cab within the meaning of the Motor Traffic (Cabs – General) (Jersey) Order 2021;

“public holiday” has the same meaning as in the Public Holidays and Bank Holidays (Jersey) Law 1951.

2        Hire charge for cabs

The maximum hire charge for the hire of a cab shall be calculated and charged in accordance with the table of fares and charges set out in the table in the Schedule, unless –

(a)     a different hire charge is agreed by the customer, being the person who agrees to hire the cab, with the driver of the cab before the journey commences; or

(b)     the hire is booked through a third party (whether an individual or organization) other than the driver and the hire charge is calculated in accordance with charges which, before the cab is booked, have been –

(i)      notified to the Minister, and

(ii)     published by the third party in such a way that the charges have been reasonably brought to the attention of the public.

3        Period of hire

(1)     For the purpose of calculating the hire charge for the hire of a cab the period of hire shall be taken as starting when a passenger enters the cab unless the cab has been summoned to a place when it shall be taken as starting when it arrives at that place.

(2)     The period of hire ends when the hire charge is tendered.

4        Citation

This Order may be cited as the Motor Traffic (Cabs – Fares and Charges) (Jersey) Order 2017.

Table of cab fares and charges

 

Journey charges

1.

Hire starting at or after 7 a.m. but before 11 p.m. on any day except on a Sunday, public holiday or bank holiday (unless covered by 3 below)

Distance fare –

 

For the first 176 yards or any shorter journey –

£3.95

For each additional 176 yards or part of that additional distance –

30p

Waiting charge –

 

For each 51 seconds, whether consecutive or not, that the cab is stationary –

30p

2.

Unless covered by 3 below, hire starting –

·   at or after 11 p.m. but before 7 a.m. on any day; or

·   at or after 7 a.m. but before 11 p.m. on a Sunday, public holiday or bank holiday

Distance fare –

 

For the first 176 yards or any shorter journey –

£4.05

For each additional 176 yards or part of that additional distance –

42p

Waiting charge –

 

For each 45 seconds, whether consecutive or not, that the cab is stationary –

42p

3.

Hire starting –

·   at or after 7 p.m. on 24 December but before 7 a.m. on 27 December; or

·   at or after 7 p.m. on 31 December but before 7 a.m. on 2 January

Distance fare –

 

For the first 176 yards or any shorter journey –

£6.95

For each additional 176 yards or part of that additional distance –

45p

Waiting charge –

 

For each 28 seconds, whether consecutive or not, that the cab is stationary –

45p

Additional charges

1.

For each passenger in excess of 4 passengers being carried

£1.00

2.

For every fare not paid in cash

50p
