Islands Lottery) (Jersey) Order 1997[1]
1 Facilities for conduct of
draws
For the purpose of conducting a draw, the Minister shall
provide –
(a) sufficient staff to
ensure the effective conduct of the draw;
(b) 2 computer systems and
a lottery draw programme capable of random selection of winning numbers and the
prizes in respect of those numbers;
(c) an apparatus capable of
containing and agitating tokens and provided with a means by which tokens may
be removed singly; and
(d) any other equipment
necessary for the effective conduct of the draw and for the verification,
recording and public announcement of the serial numbers of the winning tickets,
and of the prizes drawn in respect of those tickets.
2 Drawing
of serial numbers and prizes
(1) Each draw shall consist
of the drawing of –
(a) numbered
prizes;
(b) digit
prizes; and
(c) unless
the Minister, in accordance with Regulation 5 of the Gambling (Channel Islands Lottery) (Jersey)
Regulations 1975 (hereinafter referred to as the “Regulations”) so
determines and specifies, a jackpot prize.
(2) Every numbered and
digit prize shall be selected by computer from the prizes determined and
specified by the Minister under Regulation 5 of the Regulations
and –
(a) in
respect of a numbered prize, each winning ticket shall be determined by the
correspondence of the serial number of that ticket to a number selected at
random by computer from the serial numbers of all lottery tickets issued for
sale by the Minister or the Guernsey Committee;
(b) in
respect of a digit prize, each winning ticket shall be determined by the
correspondence of 2 or more specified digits of the serial number of that
ticket to 2 or more digits selected at random by computer from any possible
combination of digits.
(3) In respect of the
jackpot prize, the numbered prize of greatest value may be increased by the
drawing of a gold or silver token in accordance with the procedure specified in
Article 3, in respect of which there shall be payable an additional prize
as determined and specified by the Minister under Regulation 5 of the
Regulations.
3 Jackpot
prizes
(1) For the purpose of
drawing a jackpot prize the presiding officer shall place inside the apparatus
described in Article 1(c) –
(a) one
gold token denoting the golden jackpot prize;
(b) one
or more silver tokens denoting the silver jackpot prize; and
(c) one
or more black tokens denoting no additional prize.
(2) The jackpot prize shall
be determined as follows –
(a) the
apparatus shall be agitated for not less than 5 seconds;
(b) one
token shall be removed at random; and
(c) the
colour of the token so drawn shall be verified and recorded and the value of
the prize, if any, shall be publicly announced.
4 Scrutineer
(1) In addition to the
presiding officer and the other member of the Board referred to in Regulation
10(4) of the Regulations, every draw shall be conducted in the presence of a
scrutineer who shall be an officer in an administration of the States for which
the Minister is assigned responsibility, or a member of the Guernsey Committee,
or a member of the Board not being the presiding officer or other member as
aforesaid.
(2) For the purposes of
this Article the person for the time being holding office as Lottery Control
Officer for the Island of Guernsey shall be deemed to be a member of the
Guernsey Committee.
5 Manual
of procedure
The presiding officer, the member of the Board and the scrutineer
shall conform to the procedure laid down in such manual of procedure relating
to the testing and operation of the computer systems and the equipment referred
to in Article 1 as shall be approved by the Minister.
6 Result
of draw
At the conclusion of the draw the list printed out by the computer
of the serial numbers of the winning tickets and of the prizes drawn in respect
of those tickets shall constitute the list referred to in Regulation 10(6)(e)
of the Regulations.
7 Security
Access to the computer systems, the equipment and the lottery draw
programme referred to in Article 1 shall be controlled in accordance with
the procedures laid down in the manual of procedure referred to in Article 5.
8 Agents
(1) The prescribed amount
for the purposes of Regulation 12(2) and (4) of the Regulations, whereby a
prize worth equal to or less than that amount shall be claimed from an agent,
shall be £12.[2]
(2) The prescribed
commission for the purpose of Regulation 12(3)(b) of the Regulations which an
agent is entitled to receive shall be 1% of the value of the prize to which the
winning ticket relates.[3]
9 Citation
This Order may be cited as the Gambling (Channel Islands Lottery)
(Jersey) Order 1997.
