SUMMARY OF JERSEY LEGISLATION

1. LAWS ADOPTED BY THE STATES

(a)           Employment (Amendment No 6) (Jersey) Law 201-
(P.143/2010 adopted in 3rd reading, 18.1.11)

This Law amends the provisions in the Employment (Jersey) Law 2003 regarding redundancy.

(b)           States of Jersey (Miscellaneous Provisions) Law 201-
(P.176/2010 adopted in 3rd reading 20.1.11)

This Law alters the terms of office of States members, provides for a single election day in spring and reduces the number of Senators from 12 to 10.

(c)           Terrorist Asset-Freezing (Jersey) Law 201-
(P.191/2010 adopted in 3rd reading 1.2.11)

This Law requires that funds, financial services and economic resources not be made available to persons who are designated as suspected or believed to be supporting terrorist activities.

(d)           Loi (No. 7) (201-) concernant la charge de juge d’instruction
(P.148/2010 adopted in 3rd reading 15.3.11)

This Law revises the qualifications for appointment as a Magistrate or Assistant Magistrate.

(e)           Banking Business (Amendment No 7) (Jersey) Law 201-
(P.10/2011 adopted in 3rd reading 15.3.11)

This Law enables the Minister for Economic Development to make Orders relating to the accounting and audit of persons registered to carry on banking business.

(f)            Public Elections (Amendment No 4) (Jersey) Law 201-
(P.14/2011 adopted in 3rd reading 17.3.11)

This Law makes miscellaneous amendments to the arrangements for conducting, and voting in, a public election.

4. REGULATIONS MADE BY THE STATES

(a)           Restriction on Smoking (Warning Notices) (Jersey) Regulations 2011
(R&O.4/2011—in force 25.1.11)

These Regulations impose requirements for the printing of warning notices on packets of tobacco products.

(b)           Public Employees (Contributory Retirement Scheme) (Amendment No 18) (Jersey) Regulations 2011
(R&O.11/2011—in force 9.2.11)

These Regulations ensure that the Public Employees Contributory Retirement Scheme is recognized by HM Revenue and Customs as a Qualified Recognised Overseas Pension Scheme.

(c)           Public Employees (Contributory Retirement Scheme) (Existing Members) (Amendment No 11) (Jersey) Regulations 2011

These Regulations amend the Public Employees Contributory Retirement Scheme for the “existing members” group that supplement the amendments made by R&O.11/2011, described above.

(d)           Public Employees (Contributory Retirement Scheme) (New Members) (Amendment No 14) (Jersey) Regulations 2011

These Regulations amend the Public Employees Contributory Retirement Scheme for the “new members” group that supplement the amendments made by R&O.11/2011, described above.

(e)           Public Employees (Contributory Retirement Scheme) (Former Hospital Scheme) (Amendment No 5) (Jersey) Regulations 2011

These Regulations amend the Public Employees Contributory Retirement Scheme for the “former hospital scheme” group of members that supplement the amendments made by R&O.11/ 2011, described above.

(f)            Employment (Minimum Wage) (Amendment No 7) (Jersey) Regulations 2011

These Regulations provide that services charges, tips, gratuities and cover charges paid to an employee through the payroll no longer count towards payment of the minimum wage. They also increase the maximum amounts in respect of accommodation and subsistence that may be taken into account when calculating a person’s total remuneration.

(g)           Companies (Amendment No 5) (Jersey) Regulations 2011

These Regulations enable Jersey companies to merge with other bodies incorporated in or outside Jersey.

(h)           Gambling (Remote Gambling Disaster Recovery) (Amendment) (Jersey) Regulations 2011

These Regulations provide for the continuous operation of e-gambling in Jersey.

(i)            States of Jersey (Transfer of Functions No 4) (Treasury and Resources to Chief Minister) (Jersey) Regulations 2011

These Regulations transfer the functions of the Minister for Treasury and Resources under the Data Protection (Jersey) Law 2005 to the Chief Minister.

(j)            Licensing (No 17) (Jersey) Regulations 2011

These Regulations extend licensing hours on 29 and 30 April 2011.

(k)           Income Support (Amendment No 6) (Jersey) Regulations 2011
(R&O.41/2011—in force 1.6.11)

These Regulations increase the basic income support component rate for a household.

These amending Rules make provision for proceedings under the Terrorist Asset-Freezing (Jersey) Law 2011.

(R&O.57/2011—will commence on same day as Magistrate’s Court (Amendment No 10) (Jersey) Law 2011)

These Rules make provision for the service of a summons issued under the Magistrate’s Court (Miscellaneous Provisions) (Jersey) Law 1949.
