1. LAWS ADOPTED BY THE STATES

(a)   Freedom of Information (Jersey) Law 201-

        (P.39/2011—adopted in 3rd reading, 4.5.11)

This Law confers rights to be supplied with information by public authorities.

(b)   Christmas Bonus (Jersey) Law 201-

        (P.43/2011—adopted in 3rd reading, 4.5.11)

This Law alters the criteria for entitlement to the Christmas bonus and makes arrangements for appeals against decisions regarding the award of the Christmas bonus.

(c)   Architects (Registration) (Amendment No. 2) (Jersey) Law 201-

        (P.62/2011—adopted in 3rd reading, 9.6.11)

This Law amends the Architects (Registration) (Jersey) Law 1954 to take account of the repeal, in the United Kingdom, of the Architects (Registration) Act 1931 and its replacement by the Architects Act 1997.

(d)   Social Security (Amendment No. 20) (Jersey) Law 201-

        (P.64/2011—adopted in 3rd reading, 9.6.11)

This Law provides for the payment of insolvency benefit to certain employees whose employer becomes insolvent and ceases trading.

(e)   Employment (Amendment No. 7) (Jersey) Law 201-

        (P.66/2011—adopted in 3rd reading, 9.6.11)

This Law revises the redundancy provisions formerly introduced by the Employment (Amendment No. 5) (Jersey) 2010, in particular, those relating to fixed short-term contract workers.

(f)        Repatriation of Prisoners (Jersey) Law 201-

        (P.67/2011—adopted in 3rd reading, 9.6.11)

This Law facilitates the transfer, between Jersey and places outside the British Islands, of prisoners and persons compulsorily detained, pursuant to an order of a court or tribunal, in hospitals or other institutions.

(g)   Sex Offenders (Amendment) (Jersey) Law 201-

        (P.68/2011—adopted in 3rd reading, 9.6.11)

This Law makes miscellaneous amendments to the Sex Offenders (Jersey) Law 2010, in particular, in relation to an application by a person for removal of a notification requirement.

(h)   Control of Housing and Work (Jersey) Law 201-

        (P.37/2011—adopted in 3rd reading, 6.7.11)

This Law replaces the controls imposed by the Housing (Jersey) Law 1949, the Regulation of Undertakings and Development (Jersey) Law 1973 and the Hawkers and Non-Resident Traders (Jersey) Law 1965.

(i)     Register of Names and Addresses (Jersey) Law 201-

        (P.38/2011—adopted in 3rd reading, 6.7.11)

This Law provides for the establishment of a register of names and addresses of individuals in Jersey.

(j)     Income Tax (Amendment No. 38) (Jersey) Law 201-

        (P.79/2011—adopted in 3rd reading, 7.7.11)

This Law repeals the arrangements for the liability to tax of certain individuals on deemed dividends or the attribution of the profits of a company to the individual.

(k)   Civil Partnership (Jersey) Law 201-

        (P.85/2011—adopted in 3rd reading, 12.7.11)

        This Law enables same-sex couples to enter into civil partnerships.

(l)     Security Interests (Jersey) Law 201-

        (P.88/2011—adopted in 3rd reading, 19.7.11)

This Law replaces the Security Interests (Jersey) Law 1983, in respect of security interests in intangible movable property.

(m)  Medicines (Amendment No. 3) (Jersey) Law 201-

        (P.94/2011—adopted in 3rd reading, 19.7.11)

This Law enables the Minister for Health and Social Services to specify a wider range of practitioners that may prescribe medicinal products.

(n)   Public Finances (Amendment No. 3) (Jersey) Law 201-

        (P.97/2011—adopted in 3rd reading, 19.7.11)

This Law replaces the current arrangements for States’ expenditure to be set by an annual business plan with arrangements for such expenditure to be set, initially triennially, in a medium term financial plan.

(o)   Fire and Rescue Service (Jersey) Law 201-

This Law revises the functions of the Jersey Fire and Rescue Service.

(p)   Gambling (Jersey) Law 201-

        This Law replaces the Gambling (Jersey) Law 1964.

(q)   Medical Practitioners (Registration) (Amendment No. 4) (Jersey) Law 201-

This Law alters the requirements for registration of medical practitioners in Jersey and enables the Minister for Health and Social Services to arrange for the appointment of responsible officers, for the purpose of facilitating the revalidation of medical practitioners by the General Medical Council.

(r)        Long-Term Care (Jersey) Law 201-

        (P.108/2011—adopted in 3rd reading, 21.7.11)

This Law makes provision for benefits associated with long-term health care for Jersey residents.

(s)    Income Tax (Amendment No. 39) (Jersey) Law 201-

This Law introduces new rules for the taxation of persons who apply for consent under Regulation 1(1)(k) of the Housing (General Provisions) (Jersey) Regulations 1970 on or after 22 July 2011.

These Regulations re-enact, with minor changes, the limits on, and requirements for disclosure of, a candidate’s expenses in a public election and of donations to a candidate’s election campaign.

(b)   Incorporated Limited Partnerships (Jersey) Regulations 2011

These Regulations provide for the winding up of an incorporated limited partnership.

(c)   Cremation (Amendment No. 15) (Jersey) Regulations 2011

These Regulations provide for the functions under the Cremation (Jersey) Regulations 1961 formerly discharged by the Medical Officer of Health to be discharged by medical referees.

(d)   Sea Fisheries (Licensing of Fishing Boats) (Amendment No. 5) (Jersey) Regulations 2011

These Regulations enable fees to be charged for fishing boat licences, access permits and fishing permits.

(e)   Food Costs Bonus (Jersey) Regulations 2011

These Regulations replace the Food Costs Bonus (Jersey) Regulations 2008.

(f)        Health Insurance (Medical Benefit) (Amendment No. 4) (Jersey) Regulations 2011

        These Regulations increase the rate of medical benefit to £19.59.

(g)   Public Employees (Contributory Retirement Scheme) (General) (Amendment No. 11) (Jersey) Regulations 2011

These Regulations extend the obligation to make good, once the pension fund is in surplus, reductions in or cancellations of pensions made by reason of a deficit in the pension fund

These Regulations enable the Minister for Education, Sport and Culture to charge fees for the provision of nursery schools or classes for children below compulsory school age.

(i)     Companies (Amendment No. 6) (Jersey) Regulations 2011

These Regulations amend the Companies (Jersey) Law 1991 consequentially upon the commencement of the Incorporated Limited Partnerships (Jersey) Law 2011 and the Separate Limited Partnerships (Jersey) Law 2011.

(j)     Financial Services Commission (Amendment of Law) (Jersey) Regulations 2011

These Regulations revise the arrangements for the appointment of, and the termination of the appointment of, Commissioners of the Jersey Financial Services Commission.

(k)   Shipping (Registration) (Amendment) (Jersey) Regulations 2011

These Regulations amend the requirements that must be satisfied before a fishing vessel may be registered.

(l)     Social Security (Amendment of Law No. 1) (Jersey) Regulations 2011

These Regulations make miscellaneous amendments to the Social Security (Jersey) Law 1974 regarding social security contributions and the States’ contribution to supplementation of contributions.

(m)  Shops (Regulation of Opening) (Jersey) Regulations 2011

These Regulations make detailed provision regarding the opening of shops on Sundays, customary holidays and bank holidays.

(n)   Income Support (Amendment No. 7) (Jersey) Regulations 2011

These Regulations revise the conditions that must be satisfied before a person is regarded as actively seeking work and increase certain components and elements of income support.

(o)   Income Support (Special Payments) (Amendment) (Jersey) Regulations 2011

These Regulations reduce, in certain cases, the special payments payable to defray the expenses of a household that is no longer eligible for income support.

(p)   Income Tax (Prescribed Limit and Rate) (Amendment) (Jersey) Regulations 2011

These Regulations add a prescribed limit and rate for the purposes of the taxation of individuals in whose case the amendments made by the Income Tax (Amendment No. 39) (Jersey) Law 201- apply.

This Order prohibits the employment of a child under the age of 13 and regulates the employment of children over that age.

(a)   La Mare Road (Closure) (Guernsey) Law, 2011

This Law provides for the permanent closure of La Mare Road in the Parishes of Saint Pierre du Bois and Saint Saviours and vests the Road, and the land upon which it runs, for an estate of inheritance in the States of Guernsey.

(b)   Inheritance (Guernsey) Law, 2011

        (Billet d’État No. XI, 2011. Approved 29.06.11)

This Law makes amendments to the law of inheritance in Guernsey. In particular, it abolishes the rule of “forced heirship” and creates powers for the Royal Court to make orders for the benefit of the spouses, children and dependants of a deceased person where the deceased has failed to make reasonable financial provision for them.

This Ordinance, made under ss 52 and 66 of the Housing (Control of Occupation) (Guernsey) Law, 1994, enables inscription in Part A of the Housing Register of a dwelling known as Basement Flat 4, Choisi Terrace, Les Graves, Saint Peter Port.

(b)   Police Complaints (Commencement and Amendment) Ordinance, 2011

(Billet d’État No. XI of 2011. Approved 29.06.11—in force 29.06.11)

This Ordinance commences the Police Complaints (Guernsey) Law, 2008 (see Chapter A1(c) of the entries relating to Guernsey for the period 1 September–31 December 2008 at page 123 of the Law Review Volume 13) on 1 July 2011, creates transitional provisions in relation to conduct and complaints made before commencement of the Law and makes amendments to certain provisions of the Law as set out in the Schedule.

(c)   Social Insurance (Guernsey) Law (Amendment) Ordinance, 2011

(Billet d’État No. XIII of 2011. Approved 27.07.11—in force 27.07.11)

This Ordinance amends the Social Insurance (Guernsey) Law, 1978 by extending the definition of the category of persons who may benefit from work rehabilitation based schemes under the Law so as to include all insured persons, and inserting a power for the Social Security Department by regulation to deduct or authorise deduction from sums payable by way of benefit, of fees, costs or charges (including bank charges) incurred in connection with the payment of benefit under the Law.

(d)   Land Planning and Development (Fees and Miscellaneous Amendments) Ordinance, 2011

(Billet d’État No. XIII of 2011. Approved 27.07.11—in force 27.07.11)

This Ordinance amends the Land Planning and Development (Fees and Commencement) Ordinance, 2008 by inserting provision relating to fees for certain appeals to the Planning Tribunal. It also makes minor amendments to the Land Planning and Development (Guernsey) Law, 2005, the Land Planning and Development (Special Controls) Ordinance, 2007 and the Land Planning and Development (Appeals) Ordinance, 2007.

(e)   Income Tax (Guernsey) (Approval of Agreements with Romania, Canada and South Africa) Ordinance, 2011

This Ordinance specifies the agreements providing for the obtaining and exchanging of information in relation to tax, made between the States of Guernsey and the Governments of—

(d)   Housing (Control of Occupation) (Sark) Law, 2011

(Approved 06.07.11)

This Law establishes a register of restricted dwellings and prohibits the occupation by any person of a dwelling that is registered pursuant to the provisions of the Law unless the person is a qualified resident, a person of such description as the Chief Pleas may by Ordinance prescribe, a person who was, immediately prior to the commencement of the Law, in lawful occupation of the dwelling and continues to occupy that dwelling as his principal private dwelling or he is a member of the household of any such person. The Law repeals the Housing (Temporary Provisions) (Sark) Law, 1976, the Housing (Disapplication from Brecqhou) (Sark) Law, 2001 and the Housing (Temporary Provisions) (Prescribed Persons) Ordinances, 1989 and 1990.
