HEALTH INSURANCE (AMENDMENT No. 9) (JERSEY) LAW 1996

A LAW         to amend further the Health Insurance (Jersey) Law 1967, sanctioned by Order of Her Majesty in Council of the

THE STATES, subject to the sanction of Her Most Excellent Majesty in Council, have adopted the following Law –

ARTICLE 1

In Article 1 of the Health Insurance (Jersey) Law 1967,1 as amended2 (hereinafter referred to as “the principal Law”), in paragraph (1) –

(a)     in the definition of “approved supplier”, for the words “an authorized seller of poisons” there shall be substituted the words “a person lawfully conducting a retail pharmacy business”;

(b)     the definition of “authorized seller of poisons” shall be deleted;

(c)     after the definition of “order” there shall be inserted the following definition –

“ ‘person lawfully conducting a retail pharmacy business’ shall be construed in accordance with paragraph (3) of Article 68 of the Medicines (Jersey) Law 1995;3”;

(d)     after the definition of “Pharmaceutical Benefit Advisory Committee” there shall be inserted the following definition –

“ ‘pharmacist’ means a person registered as a pharmacist under the Pharmacy, Poisons and Medicines (Jersey) Law 1952;4”; and

(e)     the definition of “pharmaceutical chemist” shall be deleted.

ARTICLE 2

In Article 32 of the principal Law, for the words “three years” there shall be substituted the words “ten years”.

ARTICLE 3

In Article 33 of the principal Law, in paragraph (3), for the words “fifty pounds” there shall be substituted the words “level 2 on the standard scale5”.

ARTICLE 4

In Article 35 of the principal Law, in paragraph (2), for the words “authorized seller of poisons” there shall be substituted the words “person lawfully conducting a retail pharmacy business”.

ARTICLE 5

In Article 39 of the principal Law, in paragraph (3), for the words “ten pounds” and for the words “fifty pounds” there shall be substituted the words “level 2 on the standard scale6”.

ARTICLE 6

In Article 40 of the principal Law, in paragraph (2), for sub-paragraph (b) there shall be substituted the following sub-paragraph –

“(b)   on payment of a fee of five pounds;”.

ARTICLE 7

In Article 44 of the principal Law –

(a)     in paragraph (1), for the words “five hundred pounds” there shall be substituted the words “level 3 on the standard scale6”; and

(b)     in paragraph (2), for the words “fifty pounds”, in each place where they appear, there shall be substituted the words “level 2 on the standard scale6”.

ARTICLE 8

In the Second Schedule to the principal Law –

(a)     in paragraph 1, in sub-paragraph (2), for the words “pharmaceutical chemists” there shall be substituted the word “pharmacists”;

(b)     in paragraph 2, in sub-paragraph (b), for the words “pharmaceutical chemist” there shall be substituted the word “pharmacist”; and

(c)     in paragraph 5, for the words “pharmaceutical chemists” there shall be substituted the word “pharmacists”.

ARTICLE 9

In the Third Schedule to the principal Law –

(a)     in paragraph 3, in sub-paragraph (2), for the words “pharmaceutical chemists” there shall be substituted the word “pharmacists”; and

(b)     in paragraph 4, in clause (d) of paragraph (1), for the words “pharmaceutical chemists” there shall be substituted the word “pharmacists”.

ARTICLE 10

(1)           This Law may be cited as the Health Insurance (Amendment No. 9) (Jersey) Law 1996.

(2)           This Law shall come into force on such day or days as the States may by Act appoint, and different days may be appointed for different purposes and for different provisions of this Law.
