DEPARTMENTS OF THE JUDICIARY AND THE LEGISLATURE (AMENDMENT) (JERSEY) LAW, 1974.

A LAW   to amend the Departments of the Judiciary and the Legislature (Jersey) Law, 1965, sanctioned by Order of Her Majesty in Council of the

THE STATES, subject to the sanction of Her Most Excellent Majesty in Council, have adopted the following Law:  -

ARTICLE 1

(1)           In Article 2 of the Departments of the Judiciary and the Legislature (Jersey) Law, 1965,1 (hereinafter referred to as “the principal Law”) –

(a)     in paragraph (1) the words “, the Viscount” are hereby repealed;

(b)     paragraph (3) is hereby repealed;

(c)     after paragraph (5) there shall be inserted the following paragraph –

“(5A)   The Viscount is appointed by the Bailiff and the Deputy Viscount is appointed by the Viscount with the consent of the Bailiff.”.

(2)           After paragraph (2) of Article 3 of the principal Law2 there shall be inserted the following paragraph –

“(2A)    The Viscount may be suspended from office by the Bailiff who shall refer the matter to the States at their next sitting and may be dismissed from office by the States.”.

(3)           In the Schedule to the principal Law,3 the Oath of office of Viscount is hereby repealed and in the heading of the Oath of office of Deputy Viscount or Viscount Substitute, and in the actual oath there shall be inserted immediately before the words “Deputy Viscount” the word “Viscount,”.

ARTICLE 2

(1)           At the end of paragraph (2) of Article 2 of the principal Law,4 there shall be added the words “with the consent of the States”.

(2)           For paragraph (1) of Article 3 of the principal Law,5 there shall be substituted the following paragraph –

“(1)        The Autorisé de la Partie Publique may be suspended from office by the Attorney General who shall refer the matter to the States at their next sitting and may be dismissed from office by the States.”.

(3)           In paragraph (2) of Article 8 of the principal Law,6 the words “other than the Autorisé de la Partie Publique” and all the words after “parochial office” to the end of that paragraph shall be deleted.

ARTICLE 3

This Law may be cited as the Departments of the Judiciary and the Legislature (Amendment) (Jersey) Law, 1974.
