A LAW to amend the Food and Drugs (Jersey) Law 1966, sanctioned
by Order of Her Majesty in
Council of the
10th day of MARCH

THE
STATES, subject to
the sanction of Her Most Excellent Majesty in Council, have adopted the
following Law –
ARTICLE 1
In paragraph (3)
of Article 7 of the Food and Drugs (Jersey) Law 1966 (hereinafter referred to as
“the principal Law”) for the words commencing with the word
“liable” to the end of the paragraph there shall be substituted the
words “guilty of an offence.”.
ARTICLE 2
In paragraph (3)
of Article 11 of the principal Law for the word “five”
there shall be substituted the words “five hundred”.
ARTICLE 3
In paragraph (5)
of Article 21 of the principal Law for the word “ten”
there shall be substituted the words “two hundred”.
ARTICLE 4
In paragraph (1)
of Article 24 of the principal Law for the word “five”
there shall be substituted the words “two hundred”.
ARTICLE 5
In Article 25 of
the principal Law4 –
(a) in paragraph (1) for
the word “ten” there shall be substituted the words “five
hundred”; and
(b) in paragraph (4) for
the word “twenty” there shall be substituted the words “one
thousand”.
ARTICLE 6
In paragraph (2)
of Article 27 of the principal Law for the word “twenty”
there shall be substituted the words “one thousand”.
ARTICLE 7
In paragraph (5)
of Article 44 of the principal Law for the words commencing with the
word “liable” to the end of the paragraph there shall be
substituted the words “guilty of an offence.”.
ARTICLE 8
In Article 47 of
the principal Law –
(a) in paragraph (1) for
the word “ten” there shall be substituted the words “two
thousand”;
(b) the proviso to
paragraph (1) shall be deleted; and
(c) in paragraph (3) for
the word “ten” there shall be substituted the words “two
thousand”.
ARTICLE 9
For Article 48 of
the principal Law there shall be substituted the
following Article –
“ARTICLE 48
Punishment of offences
A person guilty
of an offence under this Law shall, unless a special punishment for that
offence is provided by this Law, be liable to a fine or to imprisonment for a
term not exceeding two years or to both.”.
ARTICLE 10
After Article 49
of the principal Law8 there shall be inserted the
following Article –
“ARTICLE 49A
Criminal liability of aiders and
abettors, etc
Without prejudice
to Article 49, any person who knowingly and wilfully
aids, abets, counsels, causes, procures or commands the commission of an
offence under this Law shall be liable to be dealt with, tried and punished as
a principal offender.”.
ARTICLE 11
In Article 62 of
the principal Law for the word “fifty” there
shall be substituted the words “two thousand”.
ARTICLE 12
This Law may be
cited as the Food and Drugs (Amendment) (Jersey) Law 1993.
