FATAL ACCIDENTS (AMENDMENT) (JERSEY) LAW 1997

A LAW       to amend the Fatal Accidents (Jersey) Law 1962, sanctioned by Order of Her Majesty in Council of the

THE STATES, subject to the sanction of Her Most Excellent Majesty in Council, have adopted the following Law –

ARTICLE 1

After paragraph (1) of Article 4 of the Fatal Accidents (Jersey) Law 19621 there shall be inserted the following new paragraph –

                “(1A)      In assessing damages payable to the spouse or child of a deceased person in respect of the death of that deceased person in any action under this Law, no account shall be taken of the re-marriage or prospects of re-marriage of the spouse of the deceased person.”.

ARTICLE 2

(1)     This Law may be cited as the Fatal Accidents (Amendment) (Jersey) Law 1997.

(2)     This Law shall not apply to any cause of action arising on a death which occurs before the Law comes into force.
