AGRICULTURAL LAND (CONTROL OF SALES AND LEASES) (AMENDMENT) (JERSEY) LAW, 1978.

A LAW   to amend the Agricultural Land (Control of Sales and Leases) (Jersey) Law, 1974, sanctioned by Order of Her Majesty in Council of the

THE STATES, subject to the sanction of Her Most Excellent Majesty in Council, have adopted the following Law:  -

ARTICLE 1

In Article 1 of the Agricultural Land (Control of Sales and Leases) (Jersey) Law, 1974,1 (hereinafter referred to as “the principal Law”), for the definition “agricultural land” there shall be substituted the following definition –

“ ‘agricultural land’ means land, including land under glass, used or capable of being used for any purpose of agriculture or horticulture, but does not include any dwelling house or outbuilding;”.

ARTICLE 2

After paragraph (2) of Article 2 of the principal Law1 there shall be inserted the following paragraph –

“(2A)    If, in pursuance of paragraph (2) of this Article, the Committee grants consent to a sale or transfer or lease of any agricultural land subject to conditions –

(i)         such conditions shall be binding on, and enforceable against, all persons for the time being having any estate or interest in the said land;

(ii)        the Committee may, at any time thereafter, waive, cancel or vary such conditions, or any of them, if requested so to do by any person having any estate or interest in the said land.”

ARTICLE 3

This Law may be cited as the Agricultural Land (Control of Sales and Leases) (Amendment) (Jersey) Law, 1978.
