HEALTH INSURANCE (AMENDMENT No. 6) (JERSEY) LAW, 1985

Her Majesty in Council of the

THE
STATES, subject to the sanction of Her Most Excellent Majesty in Council,
have adopted the following Law: -
ARTICLE
1
In Article 24 of the Health Insurance (Jersey) Law, 1967, as amended
(hereinafter referred to as “the principal Law”) –
(a) there
shall be inserted after paragraph (1) the following paragraphs –
“(1A) Subject
to the provisions of this Law, an insured person shall be entitled to
pharmaceutical benefit, that is to say, a prescribed medicine or prescribed
drug, on an order in the prescribed form given by a registered dentist for the
treatment of the insured person or any of his dependants:
Provided that a registered dentist shall not be entitled to
pharmaceutical benefit on an order given by himself for his own treatment.
(1B) Where
a registered dentist gives an order in pursuance of paragraph (1A) of this
Article the provisions of Articles 25 and 36 of this Law (in so far as the said
Article 36 relates to representation that conduct of an approved dentist has
created an unreasonable charge on the Health Insurance Fund) shall apply to him
as though he were a dentist approved under paragraph (1) of Article 35 of this
Law.
(1C) In
paragraphs (1A) and (1B) of this Article “registered dentist” has
the same meaning as in the Dentists (Registration) (Jersey) Law, 1961.”;
(b) in
paragraph (7) for the words “paragraph (1)” there shall be
substituted the words “paragraphs (1) or (1A)”.
ARTICLE

In Article 46 of the principal Law –
(a) paragraphs
(1), (2) and (3) shall be re-numbered (2), (3) and (4) respectively; and
(b) there
shall be inserted the following paragraph –
“(1) The
Committee may make orders for prescribing any matter which is to be prescribed
under this Law.”.
ARTICLE
3
This Law may be cited as the Health Insurance (Amendment No. 6)
(Jersey) Law, 1985.
