A LAW to amend further the Highways (Jersey) Law 1956, sanctioned by
Order of Her Majesty in Council of the
13th day of APRIL

THE
STATES, subject to
the sanction of Her Most Excellent Majesty in Council, have adopted the
following Law –
ARTICLE 1
(1) In
–
(a) the definition of
“highway authority” in Article 1; and
(b) paragraph (5) of
Article 4,
of the Highways
(Jersey) Law 1956, as amended (hereinafter referred to as
“the principal Law”), for the words “ ‘Comité d’Administration
des Grande Routes’ ” in each place where they occur there shall be
substituted the words “Public Services Committee”.
ARTICLE 2
After Article 5
of the principal Law there shall be inserted the following Article –
“ARTICLE 5A
POWER OF PUBLIC SERVICES COMMITTEE TO
DELEGATE FUNCTIONS
(1) Subject
to the following provision of this Article, the Public Services Committee may
delegate, either partly or wholly, its functions under this Law in relation to
any main road to the Roads Committee of the Parish in which the main road is
situated.
(2) Any
such delegation shall be made, and may be amended, modified, varied or revoked
at any time, by Act of the Committee and shall be subject to such conditions,
exceptions or qualifications as the Committee may specify by Act at any time.
(3) The
delegation of any function under this Article does not prevent the exercise of
that function by the Committee itself.”.
ARTICLE 3
This Law may be
cited as the Highways (Amendment No. 3) (Jersey) Law 1994 and shall come into
operation on such day as the States may by Act appoint.
