TERMINATION OF
TENANCIES (PROCEDURE) (JERSEY) LAW 1997

A LAW to alter certain procedures with
respect to the termination of tenancies and the eviction of tenants sanctioned
by Order of Her Majesty in Council of the
8th day of APRIL 1997

THE
STATES, subject to
the sanction of Her Most Excellent Majesty in Council, have adopted the following
Law –
ARTICLE 1
Eviction
proceedings before Petty Debts Court
(1) Notwithstanding Article
3 of the Civil Proceedings (Jersey) Law 1956, on the hearing of an action under
Article 3 of the “Loi (1946) concernant l’expulsion des locataires
refractaires”, as amended,
(hereinafter referred
to as “the Law of 1946”) the Petty Debts Court may make such order
as to the costs of the proceedings as it thinks appropriate and accordingly in
Article 3 of the Law of 1946 –
(a) in paragraph (1) the
words “les frais de la procédure et” shall be deleted; and
(b) after paragraph (4)
there shall be inserted the following paragraph –
“(5) La
Cour aura le pouvoir de condamner l’une ou l’autre des parties aux
frais.”.
(2) After paragraph (3A) of
Article 3 of the Law of 1946 there shall be inserted the following paragraph
–
“(3B) Pour les
besoins de l’alinéa (3A) de cet Article, la Cour pourra
siéger à huis clos.”.
ARTICLE 2
Short title
This Law may be
cited as the Termination of Tenancies (Procedure) (Jersey) Law 1997.
