HEALTH AND SAFETY AT WORK (AMENDMENT No. 2) (JERSEY) LAW 1997

A LAW       to amend further the Health and Safety at Work (Jersey) Law 1989, sanctioned by Order of Her Majesty in Council of the

THE STATES, subject to the sanction of Her Most Excellent Majesty in Council, have adopted the following Law –

ARTICLE 1

In paragraph (1) of Article 1 of the Health and Safety at Work (Jersey) Law 1989,1 as amended2 (hereinafter referred to as “the principal Law”), for the definition of “the Committee” there shall be substituted the following definition –

          “ ‘the Committee’ means the Employment and Social Security Committee;”.

ARTICLE 2

After paragraph (2) of Article 3 of the principal Law there shall be inserted the following paragraph –

                “(3) It shall be the duty of every employer employing five or more employees or such other number as the States may from time to time by Regulations under this paragraph provide, to –

(a)     prepare and as often as may be appropriate revise a written statement of his general policy with respect to the health and safety of his employees and the organisation and arrangements for the time being in force for carrying out that policy; and

(b)     bring the statement and any revision of it to the notice of all his employees.”.

ARTICLE 3

In sub-paragraph (d) of paragraph (2) of Article 9 of the principal Law for the words “or an inspector” there shall be substituted the words “, an inspector or any other specified body or person”.

ARTICLE 4

In Article 21 of the principal Law –

(a)     in paragraph (2) for the words “two thousand pounds” there shall be substituted the words “level 3 on the standard scale3”; and

(b)     in paragraph (5) the words “not exceeding one hundred pounds for each day on which the contravention is so continued” shall be deleted.

ARTICLE 5

This Law may be cited as the Health and Safety at Work (Amendment No. 2) (Jersey) Law 1997.
