MOTOR TRAFFIC (AMENDMENT No. 4) (JERSEY) LAW, 1949.

A LAW to
amend the Motor Traffic (Jersey) Law, 1935, sanctioned by Order of His Majesty
in Council of the
29th day of SEPTEMBER, 1949.

THE STATES, subject to the sanction of
His Most Excellent Majesty in Council, have adopted the following Law : -
ARTICLE 1
At the end of Article 13 of the Motor Traffic (Jersey) Law, 1935, (hereinafter referred to “the principal
Law”) there shall be inserted the following paragraph –
“(10) The
Committee may by Act delegate to anyone of its members all or any of its
functions under this Article.”
ARTICLE 2
In paragraph (3) of Article 19 of the principal Law, immediately after the words “at the same
time”, there shall be inserted the words “pay to the Treasurer of
the States a fee of five shillings
and”.
ARTICLE 3
In the proviso to Article 31 of the principal Law, immediately after the word “danger”,
there shall be inserted the words “or inconvenience”.
ARTICLE 4
For paragraph (1) of Article 32 of the principal Law there shall be substituted the following paragraph
–
“(1) It
shall be the duty of any person holding a Road Service Licence
under this Law to keep such accounts and records, and to make to the Committee
such financial and statistical returns in such manner and at such times, as the
Committee may require.”
ARTICLE 5
At the end of paragraph (2) of Article 36 of the principal Law, here shall be inserted the words “and may, in
addition, require him to provide facilities for a practical test of his ability
to drive a public service vehicle or public service vehicles of the type or
types in respect of which the application for a licence
is made”.
ARTICLE 6
In Article 40 of the principal Law, the words
“or acts as a conductor of” and the words “or act as a
conductor of” shall be deleted.
ARTICLE 7
(1) Immediately
after Article 49 of the principal Law there
shall be inserted the following Article –
“ARTICLE
49A
The States shall by Regulations prescribe the appropriate fees
payable in respect of the grant or renewal of licences
under Articles 13, 24 and 36 of this Law.”
(2) Paragraph
(5) of Article 13 of the principal Law is hereby
repealed.
(3) In
paragraph (1) of Article 24 of the principal Law, for the
words “a fee of one pound sterling for each form” there shall be
substituted the words “the appropriate fee”.
(4) For
paragraph (1) of Article 36 of the principal Law there shall be
substituted the following paragraph –
“(1) Every
application for a licence to drive a public service
vehicle shall be made to the Inspector on a form to be obtained from the
Treasurer of the States on payment of the appropriate fee.”
ARTICLE 8
(1) This
Law may be cited as the Motor Traffic (Amendment No. 4) (Jersey) Law, 1949, and
this Law and the Motor Traffic (Jersey) Laws, 1935 to 1939, may be cited
together as the Motor Traffic (Jersey) Laws, 1935 to 1949.
(2) This
Law shall come into force forthwith upon promulgation :
Provided that paragraphs (2), (3) and (4) of Article 7 of this Law
shall not come into force until the date of commencement of the first
Regulations made for the purposes of Article 49a
of the principal Law.
