SEA BEACHES (REMOVAL OF SAND AND STONE) (JERSEY) LAW, 1963

A LAW to
regulate the removal of sand, stone, gravel, shingle, clay or loam, sanctioned
by Order of Her Majesty in Council of the
29th day of AUGUST, 1963.

THE STATES, subject to the sanction of
Her Most Excellent Majesty in Council, have adopted the following Law : -
ARTICLE 1
GENERAL PROHIBITION
(1) No
person shall, except under and in accordance with the terms of a licence granted by the Public Works Committee –
(a) take or remove any
sand, stone, gravel, shingle, clay or loam from any sea beach in the Island ;
(b) quarry, extract or
remove any stone from any rocks forming part of the coasts of the Island or
from any rocks situated in the waters around the Island.
(2) Any
licence under paragraph (1) of this Article may be
granted subject to such conditions as the Public Works Committee may think fit
to impose.
ARTICLE 2
SAVING
Notwithstanding the provisions of Article 1 of this Law, the Harbours and Airport Committee may cause to be removed any
sand, stone, gravel, shingle, clay or loam from within any harbour
in the Island, or the approaches thereto.
ARTICLE 3
PENALTIES
Any person who acts in contravention of the provisions of this Law
or who fails to comply with the conditions of any licence
granted under Article 1 of this Law, shall be liable to a fine not exceeding
one hundred pounds or, in the case of a second or subsequent conviction, to a
fine not exceeding one hundred pounds or to imprisonment for a term not
exceeding one month or to both such fine and such imprisonment.
ARTICLE 4
REPEAL
The “Loi (1914) sur
l’enlèvement de pierres,
sable et gravier”, the
“Loi (1927) (Amendement)
sur l’enlèvement
de pierres, sable et gravier”, the “Loi (1929) (Amendement No. 2) sur l’enlèvement de pierres,
sable et gravier”, the
“Loi (1935) (Amendement
No. 3) sur l’enlèvement
de pierres, sable et gravier”, the “Loi (1949) (Amendement No. 4) sur l’enlèvement de pierres,
sable et gravier” and the
“Loi (1959) (Amendement
No. 5) sur l’enlèvement
de pierres, sable et gravier” are hereby repealed.
ARTICLE 5
SHORT TITLE
This Law may be cited as the Sea Beaches (Removal of Sand and
Stone) (Jersey) Law, 1963.
