POLICING OF ROADS, PARKS AND SEA BEACHES (APPLICATION OF FINES)
(JERSEY) LAW, 1957.

A LAW to empower the States to provide that
fines imposed for offences against Regulations relating to the policing of
roads, parks and sea beaches shall be awarded for the benefit of the Parishes,
sanctioned by Order of Her Majesty in Council of the
23rd day of AUGUST, 1957.

THE STATES,
subject to the sanction of Her Most Excellent Majesty in Council, have adopted
the following Law: -
ARTICLE 1
(1) Subject
as hereinafter provided, regulations made by the States in exercise of the
powers conferred upon them by the Order in Council of the twenty-sixth day of
December, 1851, or by the said Order in Council
and by Article 49 of the Road Traffic (Jersey) Law, 1956, may
include provisions –
(a) awarding the fine imposed for
any offence against the Regulations for the benefit of the parish in which the
offence was committed;
(b) directing the purpose to
which fines so awarded shall be applied;
(c) empowering the Constable or a
Centenier of the parish in which any such offence is committed to impose and
levy a fine summarily, so, however, that any provision so made shall not apply
where the offender refuses to accept the decision of the Constable or
Centenier.
(2) The
provisions of paragraph (1) of this Article shall apply only in relation to an
offence in respect of which the maximum fine does not exceed [five pounds] and in respect of which imprisonment may not be
imposed otherwise than for non-payment of that fine.
(3) Where
any fine is levied by a Constable or Centenier in exercise of powers conferred
upon him by virtue of this Article, he shall give a receipt for the same.
ARTICLE 2
This Law may be cited as the Policing of Roads, Parks and Sea
Beaches (Application of Fines) (Jersey) Law, 1957.
