Order of Her Majesty in Council of the

THE
STATES, subject to
the sanction of Her Most Excellent Majesty in Council, have adopted the
following Law –
ARTICLE 1
In Article 2 of
the Public Employees (Retirement) (Jersey) Law 1967, as amended –
(a) in paragraph (1) for
the words “and other dependants” there shall be substituted the
words “, widowers, children and dependants”; and
(b) in paragraph (2) after
sub-paragraph (da) there shall be inserted the following sub-paragraph –
“(db) may prescribe that if a lump sum becomes
payable from the scheme on the death of a contributory member, the Committee of
Management shall in its discretion determine –
(i) the recipients
(whether individuals or persons);
(ii) whether the lump sum is
paid wholly to one recipient or in parts to more than one recipient; and
(iii) whether the lump sum is paid
in full or only partially or not at all;”.
ARTICLE 2
(1) This
Law may be cited as the Public Employees (Retirement) (Amendment No. 5)
(Jersey) Law 1995 and, with the exception of paragraph (a) of Article 1, shall
come into force on the day of its registration.
(2) Paragraph
(a) of Article 1 of this Law shall be deemed to have come into force on the
first day of January 1993.
