THE JUDICIARY AND THE LEGISLATURE (AMENDMENT No. 2) (JERSEY) LAW 1993

A LAW to amend further the Departments of the Judiciary and the
Legislature (Jersey) Law 1965 and to repeal the Office of the Judicial Greffier (Jersey) Law 1984, sanctioned by Order of Her
Majesty in Council of the

THE
STATES, subject to
the sanction of Her Most Excellent Majesty in Council, have adopted the
following Law –
ARTICLE 1
In sub-paragraph
(b) of paragraph (1) of Article 1 of the Departments of the Judiciary and the
Legislature (Jersey) Law 1965, as amended (hereinafter referred
to as “the principal Law”), for the words “, the Solicitor
General and the Autorisé de la Partie Publique” there
shall be substituted the words “and the Solicitor General”.
ARTICLE 2
In Article 2 of
the principal Law –
(a) paragraph (2) shall be
deleted; and
(b) in paragraph (6), for
the words “, Autorisé de la Partie Publique” there
shall be substituted the words “or Judicial Greffier”.
ARTICLE 3
Paragraph (1) of
Article 3 of the principal Law shall be deleted.
ARTICLE 4
After paragraph
(1) of Article 5 of the principal Law there shall be inserted the
following paragraph –
“(1A) In the event of the absence
or incapacity of both the Attorney General and the Solicitor General the
functions of the Attorney General may be discharged by an advocate or solicitor
who is an officer in the Law Officers Department and is appointed by the
Bailiff for that purpose for such period, not exceeding seven days, as may be
specified in the appointment.”.
ARTICLE 5
In Article 7 of
the principal Law –
(a) in paragraph (1)
–
(i) for
the words “With the exception of the Autorisé
de la Partie Publique,
the” there shall be substituted the word “The”, and
(ii) after the words
“discharge the functions of” in the second place where they occur,
there shall be inserted the words “Attorney General”; and
(b) in paragraph (2), after
the words “under paragraph” there shall be inserted the words
“(1A) or”.
ARTICLE 6
The Office of
Judicial Greffier (Jersey) Law 1984 shall be repealed.
ARTICLE 7
This Law may be cited
as the Departments of the Judiciary and the Legislature (Amendment No. 2)
(Jersey) Law 1993 and shall come into force on such day as the States may by
Act appoint.
