(AMENDMENT No. 12) (JERSEY) LAW 1997

A LAW to amend further the Health
Insurance (Jersey) Law 1967, sanctioned by Order of Her Majesty in Council of
the
22nd day of JULY 1997

THE
STATES, subject to
the sanction of Her Most Excellent Majesty in Council, have adopted the
following Law –
ARTICLE 1
In the Second
Schedule to the Health Insurance (Jersey) Law 1967, as amended (hereinafter referred
to as “the principal Law”) –
(a) for paragraph 2 there
shall be substituted the following paragraph –
“2. The
Advisory Committee shall consist of –
(a) a chairman appointed by
the Committee;
(b) three approved medical
practitioners and two approved suppliers appointed in accordance with the
provisions of paragraph 6 of this Schedule;
(c) the Medical Officer of
Health;
(d) an officer of the
Department of Employment and Social Security appointed by the Committee;
(e) a pharmacist or a
medical practitioner appointed by the Committee;
(f) the Chief
Pharmacist at the General Hospital.”;
(b) in paragraph 6 for the
words “paragraph 2(d)” there shall be substituted the words
“2(b)”;
(c) in paragraph 7 –
(i) for the word
“one” there shall be substituted the word “either”; and
(ii) for the words
“paragraph 2(a)” there shall be substituted the words
“paragraph 2(d) or (e)”;
(d) in the proviso to
paragraph 8 there shall be inserted at the end the words “and a person
appointed under paragraph 2(f) of this Schedule may only appoint the Deputy
Chief Pharmacist at the General Hospital to act on his behalf”; and
(e) in paragraph 9A for the
words “one approved medical practitioner” there shall be substituted
the words “two approved medical practitioners”.
ARTICLE 2
On the day
appointed under Article 3 of this Law for the commencement of this Law the
chairman and other members of the Pharmaceutical Benefit Advisory Committee
(“the Committee”) constituted and so called by virtue of the Second
Schedule to the principal Law who held office immediately before that day cease
to hold office, but the Committee is preserved; and for the purposes of the
appointment of the chairman and members referred to in paragraph 2 of that
Schedule immediately after the commencement of this Law the proviso to
sub-paragraph (1) of paragraph 4 of that Schedule shall have effect.
ARTICLE 3
This Law may be
cited as the Health Insurance (Amendment No. 12) (Jersey) Law 1997 and shall
come into force on a day to be appointed by the States.
