Road Traffic (Saint Helier) (Amendment No. 20) (Jersey) Order 2007

THE MINISTER FOR TRANSPORT AND TECHNICAL SERVICES, in pursuance of Articles 62, 63, 64 and 84 of the Road Traffic (Jersey) Law 1956[1], and after consultation with the Connétable of St. Helier, orders as follows –

1        Interpretation

In this Order, “principal Order” means the Road Traffic (Saint Helier) (Jersey) Order 1996[2].

2        Article 2 amended

In Article 2(1) of the principal Order, the definitions “ ‘residential and business parking zone’ and ‘zone’ ” and “ ‘resident’s parking permit’ and ‘permit’ ” shall be deleted.

3        Article 10 amended

In Article 10(1) of the principal Order, in the definition “parking” –

(a)     in sub-paragraph (a), for the words “at a paying parking place;” there shall be substituted the words “on any road specified in Part 1 or 2 of Schedule 8;”;

(b)     for sub-paragraph (c) there shall be substituted the following paragraph –

“(c)    between the hours of 9 a.m. and 10 p.m. on any day, on any road specified in Part 3 of Schedule 8;”.

4        Article 20 amended

In Article 20 of the principal Order –

(a)     in paragraph (1) the words “5,” shall be deleted;

(b)     in paragraph (2) the words “5,” and “and 5” shall be deleted;

(c)     in paragraphs (4) and (5) the words “5,” shall be deleted.

5        Article 21 amended

In Article 21 of the principal Order, in paragraphs (1) and (2), the words “5,” shall be deleted.

6        Part 4 substituted

In the principal Order for Part 4 there shall be substituted the following Part –

In this Part –

‘business parking permit’ means a permit that permits parking in a zone only between the hours of 8 a.m. and 6 p.m.;

‘Connétable’ means the Connétable of St. Helier;

‘permit’ means a permit issued under Article 34 that is in force;

‘resident’s parking permit’ means a permit that permits parking in a zone at any time;

‘Richmond Road Zone’ means the area bounded by thick black lines in the map labelled Map B in Part 1 of Schedule 9;

‘Stopford Road Zone’ means the area bounded by thick black lines in the map labelled Map A in Part 1 of Schedule 9;

‘zone’ means the Richmond Road Zone or the Stopford Road Zone.

(1)     A vehicle shall not be parked at any time in a parking place specified in Part 2 of Schedule 9, or between 6 p.m. and 8 a.m. in a parking place specified in Part 3 of Schedule 9, unless –

(a)     there is in respect of that vehicle a resident’s parking permit, or a business parking permit, permitting the vehicle to be parked, in the zone in which the parking place is situated, at the time at which it is parked in the parking place; and

(b)     the vehicle is displaying the permit,

or it is parked with the permission in writing of the Connétable.

(2)     Articles 11, 12, 14, 15, 20 and 21 shall not apply to a vehicle that is parked –

(a)     for any period during a Saturday or a Sunday; and

(b)     between the hours of 5 p.m. and 9 a.m. on any other day,

in a parking place specified in Part 3 of Schedule 8 which is within a zone, if –

(i)      there is in respect of that vehicle a resident’s parking permit, or a business parking permit, permitting the vehicle to be parked, in the zone in which the parking place is situated, at the time at which it is parked in the parking place; and

(ii)      the vehicle is displaying the permit,

or it is parked with the permission in writing of the Connétable.

(3)     Despite Article 11, a vehicle which is not displaying a permit may not be parked between the hours of 10 p.m. and 9 a.m. on any day in a paying parking place specified in Part 3 of Schedule 8 that is within a zone.

(1)     A person who –

(a)     resides in a zone; and

(b)     keeps a vehicle in Jersey,

may apply in writing to the Connétable for a resident’s parking permit in respect of that vehicle.

(a)     is the owner of a business that operates from an address in a zone; and

(b)     owns a vehicle, kept in Jersey, that is used in Jersey exclusively for the purposes of the business,

may apply in writing to the Connétable for a business parking permit in respect of that vehicle.

31      Restrictions on issue of permits

(1)     A person may not hold more than one resident’s parking permit at the same time.

(2)     A permit is not transferable.

(1)     Subject to paragraph (2), the fee payable for –

(a)     a resident’s parking permit in relation to the Stopford Road Zone shall be £200;

(b)     a resident’s parking permit in relation to the Richmond Road Zone shall be £100; and

(c)     a business parking permit in relation to the Stopford Road Zone or the Richmond Road Zone shall be £150.

(2)     If a permit is to be in force for less than 12 months, the fee payable shall be, for each day for which the permit is to be in force, an amount calculated pro rata for the amount prescribed under paragraph (1).

(1)     Subject to paragraphs (2) and (3), on payment of the fee prescribed under Article 32 the Connétable shall issue to the applicant the permit requested.

(2)     The Connétable may refuse to issue a resident’s parking permit if –

(a)     he or she is not satisfied that the applicant satisfies the criteria for an application for a permit specified in Article 30(1); or

(b)     there are in force, in relation to the zone to which the permit would relate, as many resident’s parking permits or business parking permits as there are parking places in the zone.

(3)     The Connétable may refuse to issue a business parking permit if –

(a)     he or she is not satisfied that the applicant satisfies the criteria for an application for a permit specified in Article 30(2); or

(b)     there are in force, in relation to the zone to which the permit would relate, as many resident’s parking permits or business parking permits as there are parking places in the zone.

(4)     In deciding whether or not to issue a permit the Connétable may give preference to an applicant who is the holder of a disabled person’s badge issued under the Road Traffic (Disabled Persons) (Badges for Motor Vehicles) (Jersey) Order 1982[3].

(1)     Subject to paragraph (2), a permit shall be in the form specified from time to time by the Director of Traffic and Transportation.

(2)     A permit shall specify –

(a)     whether the permit is a resident’s parking permit or a business parking permit;

(b)     the zone to which the permit relates;

(c)     the registration number of the vehicle in respect of which the permit is issued;

(d)     the date on which the permit begins to have effect; and

(e)     the date on which the permit shall (unless Article 35(2) applies) cease to have effect.

(1)     Subject to paragraph (2), a permit is valid from the date on which it is issued until the following 30th April.

(2)     A permit shall cease to have effect –

(a)     if the permit is a resident’s parking permit – if the permit holder ceases to reside in the zone to which the permit relates;

(b)     if the permit is a business parking permit – if the permit holder ceases to own the business to which the permit relates; or

(c)     if the permit holder ceases to own or keep the vehicle in respect of which the permit is issued.

(3)     A permit holder shall, within 10 days of the permit ceasing to have effect by virtue of paragraph (2), surrender it to the Connétable.

If a holder of a permit in relation to a vehicle –

(a)     applies to the Connétable in writing for the issue of a permit for any other vehicle that is kept by the holder in Jersey; and

(b)     surrenders the permit to the Connétable,

the Connétable shall issue to the holder without further charge a permit for that other vehicle, for the unexpired period of the surrendered permit.

(1)     If –

(a)     a permit ceases to have effect in accordance with Article 35(2); and

(b)     the permit holder surrenders the permit to the Connétable,

the Connétable shall refund to the holder, for the unexpired period of the permit, a proportion of the fee paid by the permit holder calculated in accordance with paragraph (2).

(2)     The amount to be refunded shall be, for each full month for which the permit shall cease to be in force, 1/12th of the amount that would have been payable for a permit under Article 32(1), less an administration charge of £10.

A permit holder shall, within 10 days of changing his or her residential address in a zone, or his or her business address in a zone, inform the Connétable in writing.”.

7        Article 40 amended

In Article 40 of the principal Order –

(a)     for the words “Motor cycles” there shall be substituted the words “(1) Motor cycles”;

(b)     at the end there shall be added the following paragraph –

“(2)    Motor cycles and mopeds shall not be parked on an area of road specified in Part 2 or Part 3 of Schedule 9.”.

8        Schedule 1 amended

In Schedule 1 to the principal Order, in Part 1 –

(a)     for the item “Great Union Road (between Devonshire Place and Great Union Street)” in the first column and the entry in the second column opposite that item there shall be substituted the following items and entries –

“Great Union Road

Devonshire Place to Great Union Street

Great Union Street

Great Union Road to Devonshire Place”;

(b)     the item relating to “Old Street” in the first column and the entry in the second column opposite that item shall be deleted.

9        Schedule 3 amended

In Schedule 3 to the principal Order –

(a)     after the group of roads “Gloucester Street Seaton Place” there shall be inserted the following group of roads –

“Hue Street

Union Street”;

(b)     before the group of roads “Patriotic Street Newgate Street” there shall be inserted the following group of roads –

“Parade, The

Union Street”.

10      Schedule 4 amended

In Schedule 4 to the principal Order –

(a)     for the entry in the second column opposite the item “Aquila Road” in the first column there shall be substituted the following entries –

“West side

East side (between a point 51 yards north of its junction with Devonshire Lane and a point 9 yards further north, and between a point 74 yards north of its junction with Devonshire Lane and a point 22 yards further north)”;

(b)     after the entry in the second column opposite the item “Beresford Street” in the first column there shall be inserted the following entry –

“South side (between its junction with Bath Street and a point 30 yards west)”;

(c)     for the first entry in the second column opposite the item “Cannon Street” in the first column there shall be substituted the following entry –

“South side (between a point 30 yards west of its junction with Bath Street and its junction with Halkett Street)”;

(b)     after the item “Caledonia Place” in the first column and the entry in the second column opposite that item there shall be inserted the following items and entries –

“La Colomberie

South side (between a point 10 yards east of its junction with Roseville Street and a point 24 yards further east)

La Motte Street

North side (between the western boundary of No. 39 La Motte Street and a point 18 yards east)”;

(6)     In Schedule 8 to the principal Order, in Part 13, the item “Richmond Road” in column 1 and the entries opposite in column 2 shall be deleted.

12      Schedule 9 amended

(1)     In Schedule 9 to the principal Order, in Part 1 –

(a)     for the words “Articles 2(1)” there shall be substituted the words “Articles 28”;

(b)     for the heading there shall be substituted the following headings –

“SAINT HELIER RESIDENTIAL AND BUSINESS PARKING ZONES

(c)     at the end there shall be inserted the matter set out in the Schedule to this Order.

15      Citation and commencement

(1)     This Order may be cited as the Road Traffic (Saint Helier) (Amendment No. 20) (Jersey) Order 2007.

(2)     This Order shall come into force 14 days after it is made.
