Motor Vehicles
(Construction and Use) (Amendment No. 5) (Jersey)

THE HOME AFFAIRS COMMITTEE, in pursuance of Articles 39A and 42 of
the Road Traffic
(Jersey) Law 1956,[1] orders as follows –
1 Amendment
For Article 2(7) of the Motor Vehicles (Construction and Use) (Jersey)
Order 1998[2] there shall be substituted
the following paragraph –
“(7) For the purposes of Article 39A(2)
of the Law,[3] the fee to accompany an
application for a licence authorizing the use of a vehicle not complying with
orders under Article 39 of the Law[4] shall be –
(a) if the application is for a licence for the
use of the vehicle on a specified journey or for a specified purpose or for a
period of not more than 12 months – £69.40;
(b) if the application is for a licence for the
use of the vehicle in any other case – £123.90;
(c) if the actual application is a second or
subsequent application (after an earlier application under Article 39A of
the Law[5] was refused within the
period of 30 days before the actual application was made) and both or all the applications
are for a licence for the use of the vehicle as referred to in sub-paragraph
(b) – £61.95.”.
2 Revocation
The Motor Vehicles (Construction
and Use) (Amendment No. 4) (Jersey) Order 2002[6] shall be revoked.
3 Citation
and commencement
This Order may be cited as the Motor Vehicles (Construction and Use)
(Amendment No. 5) (Jersey) Order 2004 and shall come into force on 2nd February 2004.
