Road Traffic
(Public Parking Places – Charges) (Jersey) Order 2008

THE MINISTER FOR TRANSPORT AND TECHNICAL SERVICES, in pursuance of Articles 59 and
84 of the Road Traffic (Jersey) Law 1956[1] and with the concurrence of the
Minister for Treasury and Resources, orders as follows –
1 Interpretation
(1) This
Order shall be read as one with the Road Traffic (Public Parking Places)
(Jersey) Order 2006[2].
(2) In
this Order, “hybrid vehicle” means a motor vehicle that is partly
propelled by electricity and is capable of travelling on electricity alone.
(3) In
this Order a reference to a mass of carbon dioxide emitted per kilometre is a
reference to such a mass determined as a vehicle emission in accordance with
Annex I to Commission Directive No. 93/116/EC.
2 Parking
unit value
A parking unit shall have a value of –
(a) except
in the cases referred to in paragraphs (b) and (c) – 54 pence;
(b) in
the case where the relevant pay card is displayed on a vehicle (including a
hybrid vehicle) along with a document approved by the Minister indicating that
the vehicle emits no more than 100 grams of carbon dioxide per
kilometre – 27 pence; or
(c) in
the case where the relevant pay card is displayed on a hybrid vehicle along
with a document approved by the Minister indicating that the vehicle emits no
more than 120 grams of carbon dioxide per kilometre –27 pence.
3 Excess
charge
(1) The
excess charge shall be –
(a) £40
if payment of the charge is received at the address specified in
paragraph (2) not later than 4 p.m. of the third day after the day on
which the excess charge was incurred (excluding any Saturday, Sunday or public
holiday); or
(b) £60
in any other case.
(2) For
the purpose of paragraph (1)(a) the address is –
(a) if
the excess charge notice was issued on behalf of a parochial authority, the
parish hall of the parochial authority;
(b) if
the excess notice was issued on behalf of the Minister for Education, Sports
and Culture, the Finance Department, Education, Sport and Culture, PO Box 142,
Highlands, St. Saviour, JE4 8QJ; or
(c) in
any other case, the Parking Control Office, Sand Street Car Park,
St. Helier, JE2 3QF.
4 Season
ticket charge, except for low-emission vehicles
Except as provided in Article 5, the charge for a monthly
season ticket shall be –
(a) £46
if the season ticket only authorizes a vehicle to be parked in the parking
places specified in Parts 2 and 3 of Schedule 3 to the Road Traffic
(Public Parking Places) (Jersey) Order 2006; or
(b) £92
if it also authorizes the vehicle to be parked in the following parking
places –

5 Season
ticket charge, for low-emission vehicles
(1) This
Article applies in the case where a monthly season ticket is displayed –
(a) on
a vehicle (including a hybrid vehicle) along with a document approved by the
Minister indicating that the vehicle emits no more than 100 grams of carbon
dioxide per kilometre; or
(b) on
a hybrid vehicle along with a document approved by the Minister indicating that
the vehicle emits no more than 120 grams of carbon dioxide per kilometre.
(2) In
a case to which this Article applies, the charge for a monthly season ticket
shall be –
(a) £23
if the season ticket only authorizes a vehicle to be parked in the parking
places specified in Parts 2 and 3 of Schedule 3 to the Road Traffic
(Public Parking Places) (Jersey) Order 2006; or
(b) £46
if it also authorizes the vehicle to be parked in the following parking
places –

6 Amendment
of Road Traffic (Public Parking Places) (Jersey) Order 2006
In Article 1(1) of the Road Traffic (Public Parking Places)
(Jersey) Order 2006[3] in the definition
“parking unit” after the word “value” the words
“or values” shall be inserted.
7 Revocation
The Road Traffic (Public Parking Places – Charges)
(Jersey) Order 2006[4] and the Road Traffic (Public Parking Places –
Charges) (Amendment) (Jersey) Order 2007[5] are revoked.
8 Citation
and commencement
This Order may be cited as the Road Traffic (Public Parking
Places – Charges) (Jersey) Order 2008 and shall come into force
on 1st February 2008.
