Long-Term Care (Benefits) (Amendment No. 3) (Jersey) Order 2017

THE MINISTER FOR SOCIAL SECURITY, in pursuance of Articles 3, 4 and 16 of the Long-Term Care (Jersey) Law 2012[1], orders as follows –

1        Interpretation

In this Order “principal Order” means the Long-Term Care (Benefits) (Jersey) Order 2014[2].

2        Article 5 amended

In Article 5(a)(ii) of the principal Order for the words “under 19 years” there shall be substituted the words “under 25 years”.

3        Article 8 amended

In Article 8 of the principal Order, for the table there shall be substituted the following table –

4        Article 9 amended

In Article 9(c) of the principal Order –

(a)     for the amount “£318.43” there shall be substituted the amount “£326.97”;

(b)     for the amount “£34.72” there shall be substituted the amount “£35.70”.

5        Article 10 amended

In Article 10 of the principal Order –

(a)     in paragraphs (1) and (2)(a), for the amount “£53,060” there shall be substituted the amount “£54,480”;

(b)     in paragraph (2)(b), for the amount “£79,590” there shall be substituted the amount “£81,720”.

6        Article 12 amended

In Article 12 of the principal Order –

(a)     in paragraph (2)(b), for the amount “£318.43” there shall be substituted the amount “£326.97”;

(b)     in paragraph (5)(c), for the amount “£318.43” there shall be substituted the amount “£326.97”.

7        Article 15 amended

In Article 15(1) of the principal Order –

(a)     for the words “when the latest of sub-paragraph (a) or (b) occurs” there shall be substituted the words “if any of the following occurs”;

(b)     for sub-paragraph (b), there shall be substituted the following sub-paragraph –

“(b)    the eligible person who received long-term care has died and none of the following occupy the principal residence that, at the date of the eligible person’s death, was owned by the eligible person or the eligible person’s partner –

(i)      the eligible person’s partner, or

(ii)      an adult who lived with, and was a carer for, the eligible person for a period of at least 12 months (or such lesser period that a determining officer considers reasonable in all the circumstances of the case) before –

(A)    the date the eligible person moved into an approved home, or

(B)     the date of the eligible person’s death, where the eligible person received long-term care in his or her principal residence,

and who has continued to live in the principal residence since that date.”.

8        Citation and commencement

This Order may be cited as the Long-Term Care (Benefits) (Amendment No. 3) (Jersey) Order 2017 and shall come into force on 1st April 2017.
