States of Jersey (Amendments and Construction Provisions No. 1) (Jersey) Regulations 2005

Coming into force                            in accordance with Regulation 12

THE STATES, in pursuance of Article 49 of the States of Jersey Law 2005,[1] have made the following Regulations –

1        Civil Service Administration (Jersey) Law 1948

(1)     In this Regulation, any reference to a provision is a reference to the provision in the Civil Service Administration (Jersey) Law 1948.[2]

(2)     In Article 1 for the definition “Committee” there shall be substituted the following definition –

“ ‘Minister’ means the Chief Minister;”.

(3)     Article 2 shall be deleted.

(4)     In Article 5 –

(a)     for paragraph (1) there shall be substituted the following paragraphs –

“(1)    Officers shall be employed by the Minister.

(1A)   No officer may be appointed to or dismissed from office except by the Committee or the States.

(1B)   In the exercise of its functions under paragraph (1) and (1A), the Minister shall have regard to the views of the authority to whom the officer is, or is to be, allocated.”.

(b)     in paragraph (2) the second proviso shall be deleted;

(c)     for the word “Committee” in each place where it appears there shall be substituted the word “Minister”.

(5)     In the following provisions for the words “Policy and Resources Committee” in each place where they appear there shall be substituted the word “Minister” –

(a)     Article 3;

(b)     Article 4.

(6)     In Article 7 the words “Committee of the States or other” shall be deleted.

(7)     In the following provisions for the words “the Committee” in each place where it appears there shall be substituted the words “the Minister” –

(a)     Article 1, definition of “officer”;

(b)     Article 6;

(c)     Article 7.

2        Departments of the Judiciary and the Legislature (Jersey) Law 1965

In Article 8 of the Departments of the Judiciary and the Legislature (Jersey) Law 1965[3] in paragraph (1) for the words “by the Policy and Resources Committee” there shall be substituted the words “by the Chief Minister”.

3        Public Employees (Retirement) (Jersey) Law 1967

(1)     In this Regulation, any reference to a provision is a reference to the provision in the Public Employees (Retirement) (Jersey) Law 1967.[4]

(2)     In Article 1 –

(a)     the definition “Committee” shall be deleted;

(b)     after the definition “fund” there shall be inserted the following definition –

“ ‘Minister’ means the Chief Minister;”.

(3)     In Articles 2(3) and 3(2) and (3) for the words “Finance and Economics Committee” in each place where they appear there shall be substituted the words “Minister for Treasury and Resources”.

(4)     In Article 3(4) and (7) and 4 for the words “the Committee” in each place where they appear there shall be substituted the words “the Minister”.

(5)     In Article 3(5) for the words “The Committee” there shall be substituted the words “The Minister”.

4        Emergency Powers and Planning (Jersey) Law 1990

(1)     In this Regulation, any reference to a provision is a reference to the provision in the Emergency Powers and Planning (Jersey) Law 1990.[5]

(2)     In Article 1(1) for sub-paragraph (b) there shall be substituted the following sub-paragraph –

“(b)    the Chief Minister, the Minister for Home Affairs, the Minister for Economic Development, the Minister for Public Services and the Minister for Health and Social Services;”.

(3)     In Article 4 for the words “Committee of the States” there shall be substituted the word “Minister”.

5        European Communities Legislation (Implementation) (Jersey) Law 1996

(1)     In this Regulation, any reference to a provision is a reference to the provision in the European Communities Legislation (Implementation) (Jersey) Law 1996.[6]

(2)     In Article 1 –

(a)     in the definition “1973 Law” for the full stop there shall be substituted a colon;

(b)     after the definition “1973 Law” there shall be inserted the following definition –

“ ‘Minister’ means the Chief Minister.”.

(3)     In Article 2(4) for the words “Policy and Resources Committee” in each place where they appear there shall be substituted the word “Minister”.

6        Hong Kong Economic and Trade Office (Privileges and Immunities) (Jersey) Law 1998

In the Schedule to the Hong Kong Economic and Trade Office (Privileges and Immunities) (Jersey) Law 1998[7] –

(a)     in paragraph 1 the definition “the Committee” shall be deleted;

(b)     in paragraphs 5 and 6 for the word “Committee” there shall be substituted the words “Chief Minister”.

7        Privileges and Immunities (Diplomatic, Consular, etc.)(Jersey) Law 1998

In the Third Schedule to the Privileges and Immunities (Diplomatic, Consular, etc.) (Jersey) Law 1998,[8] in paragraphs 5, 7 and 14 for the words “Policy and Resources Committee” there shall be substituted the words “Minister for Treasury and Resources”.

8        Human Rights (Jersey) Law 2000

(1)     In this Regulation, any reference to a provision is a reference to the provision in the Human Rights (Jersey) Law 2000.[9]

(2)     In Article 1(1) –

(a)     for the definition “Committee” there shall be substituted the following definition –

“ ‘Committee of Ministers’ means the Committee of Ministers of the Council of Europe;”;

(b)     after the definition “Designation Order” there shall be inserted the following definition –

“ ‘Minister’, except in Articles 3(2), 8(8) and 16, means the Chief Minister;”.

(3)     In Article 2(2) for the words “as it thinks” there shall be substituted the words “as the Minister thinks”.

(4)     In Article 3(2)(c) for the word “Committee” there shall be substituted the word “Minister”.

(5)     In Article 8(8) –

(a)     for the words “The Committee” there shall be substituted the words “A Minister”;

(b)     for the words “that it considers” there shall be substituted the words “that he or she considers”.

(6)     In Articles 14(3) and 15(3) for the words “as it thinks” there shall be substituted the words “as he or she thinks”.

(7)     In Article 16(1) –

(a)     for the words “A Committee which” there shall be substituted the words “A Minister who”;

(b)     in sub-paragraph (a) for the words “in its view” there shall be substituted the words “in the Minister’s view”;

(c)     in sub-paragraph (b) for the words “it is unable to make a statement of compatibility, it” there shall be substituted the words “the Minister is unable to make a statement of compatibility, he or she”.

(8)     In the following provisions for the word “Committee” in each place where it appears there shall be substituted the word “Minister” –

(a)     Article 1(1), definition of “Designation Order”;

9        Crime and Security (Jersey) Law 2003

(1)     In this Regulation, any reference to a provision is a reference to the provision in the Crime and Security (Jersey) Law 2003.[10]

(2)     In Article 1(1) –

(a)     the definition “Committee” shall be deleted;

(b)     in the definition “freezing order” for the word “Committee” there shall be substituted the word “Minister”;

(c)     after the definition “Island person” there shall be inserted the following definition –

“ ‘Minister’ means the Chief Minister;”.

(3)     In the following provisions for the word “Committee” in each place where it appears there shall be substituted the word “Minister” –

(a)     Article 7(1) and (2);

(b)     Article 8(3)(a) and (b);

(c)     Article 9(1);

(d)     Article 12(1);

(e)     Schedule, paragraphs 4(2)(g), 5(2)(a), 6(5) and (6) and 10 and the heading to paragraph 10.

10      Construction of Order in Council

In the Nuclear Safeguards Act 2000 of the United Kingdom, extended to Jersey by The Nuclear Safeguards (Jersey) Order 2004,[11] insofar as that Act extends to Jersey a reference to the Policy and Resources Committee shall be construed as a reference to the Chief Minister.

11      Subordinate enactments amended

The enactments set out in the Schedule shall be amended as set out in that Schedule.

12      Citation and commencement

These Regulations may be cited as the States of Jersey (Amendments and Construction Provisions No. 1) (Jersey) Regulations 2005 and shall come into force on the date on which Article 42(3) of the States of Jersey Law 2005[12] comes into force.

(a)     for the definition “administering authority” there shall be substituted the following definition –

“ ‘administering authority’, in relation to any officer, means the Minister to whom has been assigned responsibility for the administration of the States in which the officer is employed, or if there is no such Minister, the Chief Minister;”;

(2)     In Rule 5(1), for the words “Policy and Resources Committee (in these Rules called the ‘Committee’) previously given in writing, and the Committee shall not give such permission unless it has satisfied itself” there shall be substituted the words “Minister previously given in writing, and the Minister shall not give such permission unless he or she is satisfied”.

(3)     In Rules 7 and 9(1) for the word “Committee” there shall be substituted the word “Department”.

(4)     In the following provisions for the word “Committee” in each place where it appears there shall be substituted the word “Minister” –

In Rule 1 of the Civil Service Administration (Language Proficiency Allowances) (Jersey) Rules 1973[18] 

(a)     in paragraph (1) for the words “the Policy and Resources Committee (hereinafter referred to as the ‘Committee’)” there shall be substituted the words “the Minister”;

(b)     in paragraphs (2) and (3) for the word “Committee” there shall be substituted the word “Minister”.

7        Civil Service Administration (Shift Allowances) (Jersey) Order 1979

In Articles 3 and 4(2) of the Civil Service Administration (Shift Allowances) (Jersey) Order 1979[19] for the word “Committee” there shall be substituted the word “Minister”.

8        Civil Service Administration (Salaries) (Jersey) Order 1982

(1)     In this paragraph, any reference to a provision is a reference to the provision in the Civil Service Administration (Salaries) (Jersey) Order 1982.[20]

(2)     In Article 6(3) for the words “if it thinks fit,” there shall be substituted the words “if he or she thinks fit,”.

(2)     In Regulation 1, in paragraph (1), the definition “Committee” shall be deleted.

(3)     For Regulation 3 there shall be substituted the following Regulation –

The Minister shall maintain the fund, to be managed in accordance with Article 3 of the Law, established for the purposes of the scheme under these Regulations before the States of Jersey Law 2005 came into force.”.

(2)     In Regulation 17(1), for the words “that Committee” there shall be substituted the words “he or she”.

15      Community Provisions (Prohibiting the sale and supply of petroleum and certain petroleum products to the Federal Republic of Yugoslavia) (Jersey) Regulations 1999

(1)     In this paragraph, any reference to a provision is a reference to the provision in the Community Provisions (Prohibiting the sale and supply of petroleum and certain petroleum products to the Federal Republic of Yugoslavia) (Jersey) Regulations 1999.[27]

(2)     In Regulation 1 the definition “Committee” shall be deleted.

(3)     In Regulations 4(1) and (3) for the word “Committee” there shall be substituted the word “Minister”.

16      Community Provisions (Maintaining a freeze of funds in relation to Mr Milosevic and associated persons) (Jersey) Order 2000

In the Community Provisions (Maintaining a freeze of funds in relation to Mr. Milosevic and associated persons) (Jersey) Order 2000[28] 

(a)     in Article 2(k) for the words “Policy and Resources Committee” there shall be substituted the word “Minister”;

(b)     for Article 6 there shall be substituted the following Article –

“6      Power of Minister to delegate

The Minister may, to the extent and subject to the restrictions and conditions that he or she may think proper, delegate or authorize the delegation of any of the Minister’s functions under the Community provisions to any person, or class or description of person, approved by the Minister, and references in the Community provisions to the competent authorities shall be construed accordingly.”.

17      Community Provisions (Restrictive measures in respect of the Democratic Republic of Congo) (Jersey) Order 2003

(1)     In this paragraph, any reference to a provision is a reference to the provision in the Community Provisions (Restrictive measures in respect of the Democratic Republic of Congo) (Jersey) Order 2003.[29]

(2)     In Article 1 the definition “Committee” shall be deleted.

(3)     In Article 2(1) for the words “Policy and Resources Committee”, in each place where they appear there shall be substituted the word “Minister”.

(4)     In Article 3 for the word “Committee” there shall be substituted the word “Minister”.

(5)     For Article 6 there shall be substituted the following Article –

18      Community Provisions (Restrictive measures in respect of Sudan) (Jersey) Order 2004

(1)     In this paragraph, any reference to a provision is a reference to the provision in the Community Provisions (Restrictive measures in respect of Sudan) (Jersey) Order 2004.[30]

(2)     In Article 1 the definition “Committee” shall be deleted.

(3)     In Article 6 for the words “as it may think” there shall be substituted the words “as the Minister may think”.
