HARBOURS (AMENDMENT No. 32) (JERSEY) REGULATIONS 2001

                THE STATES, in pursuance of Article 4 of the Harbours (Administration) (Jersey) Law 1961,[1] as amended,[2] have made the following Regulations -

 

                1.      In these Regulations “principal Regulations” means the  Harbours (Jersey) Regulations 1962, as amended.[3]

 

                2.      In Regulation 24 of the principal Regulations -

 

                (a)     for paragraphs (2) and (2A) there shall be substituted the following paragraphs -

 

          “(2)   Where a person, without the permission of the Harbour Master, allows any goods to remain on a harbour in excess of the period specified in Part I of the First Schedule to these Regulations in relation to goods of that description he shall be liable to the daily charge specified in Part II of that Schedule in relation to the goods in question for each working day or part thereof during which those goods remain on a harbour in excess of that period.

 

          (2A) The Committee may, in exceptional circumstances, reduce the amount of the charge to which a person would otherwise be liable under paragraph (2) of this Regulation.”; and

 

                (b)     after paragraph (4) there shall be inserted the following paragraph -

 

          “(5)   In this Regulation and in the First Schedule to these Regulations “working day” means any day other than a Saturday or Sunday, Christmas Day, Good Friday or any day appointed as a public holiday or bank holiday under the Public Holidays and Bank Holidays (Jersey) Law 1951, as amended.”.

 

                3.      For the First Schedule to the principal Regulations there shall be substituted the Schedule set out in the Schedule to these Regulations.

 

                4.      The following Regulations shall be repealed -

 

                (a)     the Harbours (Amendment No. 8) (Jersey) Regulations 1976;[4]

 

                (b)     the Harbours (Amendment No. 10) (Jersey) Regulations 1980;[5]

 

                (c)     the Harbours (Amendment No. 12) (Jersey) Regulations 1983;[6]

 

                (d)     the Harbours (Amendment No. 21) (Jersey) Regulations 1992;[7]

 

                (e)     the Harbours (Amendment No. 24) (Jersey) Regulations 1995;[8]

 

                (f)      the Harbours (Amendment No. 26) (Jersey) Regulations 1997;[9] and

 

                (g)     the Harbours (Amendment No. 31) (Jersey) Regulations 2000.[10]

 

                5.      These Regulations may be cited as the Harbours (Amendment No. 32) (Jersey) Regulations 2001 and shall come into force on the day following promulgation.

SCHEDULE

 

“FIRST SCHEDULE

 

(Regulation 24)

 

PART I

 

Period during which goods may remain on a harbour

 

Description of goods

Period

 

 

1.   Inbound goods not specified in item 2 of this Part of this Schedule

The day of arrival plus 3 working days

 

 

2.   Inbound vehicles for trade and unaccompanied vehicles (other than vehicles being shipped for the use of a person  travelling to the Island separately)

Where the vehicle arrives before midday, the period from its arrival to midnight that same day (or if that day is not a working day, the next working day); and where the vehicle arrives after midday, the period from its arrival to 6 p.m. the following day (or if that day is not a working day, the next working day)

 

 

3.   Outbound empty trailers, flats, containers and cargo for bulk carriers

The day of arrival plus 5 working days

 

 

4.   Any vehicle not specified in item 2 of this Part of this Schedule

12 hours in any working day

 

 

5.   Any goods not otherwise specified in this Part of this Schedule

The day of arrival plus 2 working days


 

PART II

 

Charges for goods remaining on a harbour longer than the period specified in Part I of this Schedule
