SOCIAL SECURITY (CLASSIFICATION) (AMENDMENT No. 3) (JERSEY) ORDER
2000

THE EMPLOYMENT AND SOCIAL SECURITY COMMITTEE,
in pursuance of Articles 3 and 51 of the Social Security (Jersey) Law 1974, as amended, orders as follows –
1. In this Order “principal Order”
means the Social Security (Classification) (Jersey) Order 1974, as amended.
2. In Article 1(1) of the principal
Order for the definition of “company” there shall be substituted the following
definition –
“ ‘company’ has the meaning assigned to it by Article 1 of the
Companies (Jersey) Law 1991;”.
3. For columns A and B respectively of
paragraph 23 of Part II of the First Schedule to the principal Order there shall
be substituted, in columns A and B respectively, the following paragraphs –
“23.

Employment under a contract of
service which is subsidiary to other employment, not being employment under a
contract of service, where the Committee is satisfied that –
|

|
None.
|
|
(a)
|
that contract of service was
entered into with a view to avoiding liability to pay Class 2 contributions;
or
|
|
|
|
(b)
|
classification as an employed
person by virtue of that employment would lead to inequalities or injustice
to the general body of insured persons or to any class of insured persons.
|
|
|
24.
|
Employment by a limited liability
company where the Committee is satisfied that the insured person, his spouse,
nominee or other agent –
|
24.
|
None.
|
|
(a)
|
is beneficially entitled to not
less than one half of the total shares of that company; or
|
|
|
|
(b)
|
otherwise has substantial control
of the operations of that company.”.
|

|
4. This Order may be cited as the
Social Security (Classification) (Amendment No. 3) (Jersey) Order 2000 and
shall come into force on the first day of June 2000.
