(Public Parking Places) (Miscellaneous Amendments No. 4) (Jersey) Order 2017

THE MINISTER FOR INFRASTRUCTURE, in pursuance of Articles 59 and 84 of
the Road Traffic (Jersey) Law 1956[1], orders as follows –
1 Road
Traffic (Public Parking Places) (Jersey) Order 2006 amended
In the Road Traffic (Public Parking Places) (Jersey) Order 2006[2] –
(a) in
Article 1(1) –
(i) in
the definition “season ticket” the words “on which the ticket
is displayed” shall be deleted,
(ii) after
the definition “valid permit” there shall be inserted the following
definition –
“ ‘valid
remote payment’ means a payment in respect of a vehicle parked or to be
parked in a parking place, such payment being –
(a) made by means of the internet;
(b) accepted by or on behalf of the Minister;
and
(c) of the amount of the prescribed charge required
to be paid to park the vehicle in that parking place for the period during which
it is parked or to be parked;”;
(b) in
Article 3(e) after the words “valid permit is displayed” there
shall be added the words “or a valid remote payment has been made”;
(c) at
the end of Article 5(1) and (1A) there shall be added the words “or
a valid remote payment has been made”;
(d) after
Article 7 there shall be inserted the following Article –
(1) A digital photograph taken by a car park
official of a vehicle displaying a registration mark that is parked in a parking
place shall be prima facie evidence that the vehicle assigned that registration
mark was parked in that parking place.
(2) The metadata associated with the digital
photograph shall be prima facie evidence of the time and day the photograph was
taken.
(3) A printed copy of the records, held by or on
behalf of the Minister, of valid remote payments made in respect of vehicles
shall be prima facie evidence of whether a valid remote payment was made in
respect of a vehicle.”.
2 Road
Traffic (Sand Street Car Park) (Jersey) Order 2012 amended
In the Road Traffic (Sand Street Car Park) (Jersey) Order 2012[3] –
(a) in
Article 1(1) for the full-stop after the definition “registered
owner” there shall be substituted a semi-colon and there shall be added
the following definition –
“ ‘valid
remote payment’ means a payment in respect of a vehicle parked or to be
parked in the car park, such payment being –
(a) made by means of the internet;
(b) accepted by or on behalf of the Minister;
and
(c) of the amount of the prescribed charge
required to be paid to park the vehicle in the car park for the period during which
it is parked or to be parked.”;
(b) in Article 5(1)
after the words “first being paid” there shall be added the words
“, either by valid remote payment or at a parking charges payment
terminal”;
(c) in
Article 5(6) before the words “a vehicle is parked” there
shall be inserted the words “in the case of a vehicle parked in the car
park for any period in respect of which a valid remote payment has not been
made,”;
(d) in
Article 6(1) after the words the words “Article 5(6)” there
shall be added the words “, or the end of a period in respect of which a valid
remote payment has been made, as the case may be”;
(e) in
Article 12(2) after the words “parking charge was paid” there
shall be inserted the words “at the terminal”;
(f) after
Article 12(2) there shall be added the following paragraph –
“(3) A printed copy of the
records, held by or on behalf of the Minister, of valid remote payments made in
respect of vehicles shall be prima facie evidence of whether a valid remote
payment was made in respect of a vehicle.”.

Traffic (Public Parking Places – Charges) (Jersey) Order 2017 amended
In the Road Traffic (Public Parking Places – Charges) (Jersey)
Order 2017[4] –
(a) In
Article 2(2) for the words “where the relevant pay card is displayed
on a vehicle along with” there shall be substituted the words “in
the case of a vehicle in which there is displayed”;
(b) In
Article 3(3) for the words “displayed on a vehicle along with”
there shall be substituted the words “in the case of a vehicle in which
there is displayed”.
4 Citation
and commencement
This Order may be cited as the Road Traffic (Public Parking Places)
(Miscellaneous Amendments No. 4) (Jersey) Order 2017 and shall come
into force 7 days after the day it is made.
