Road Traffic (St. Helier) (Amendment No. 22) (Jersey) Order 2008

THE MINISTER FOR TRANSPORT AND TECHNICAL SERVICES, in pursuance of Articles 62, 63, 64 and 84 of the Road Traffic (Jersey) Law 1956[1], and after consultation with the Connétable of St. Helier orders as follows –

1        Interpretation

In this Order, “principal Order” means the Road Traffic (St. Helier) (Jersey) Order 1996[2].

2        Article 10 amended

In Article 10(1) of the principal Order, for the definition “valid parking card”, there shall be substituted the following definition –

“ ‘valid parking card’ means a parking card that identifies for the purposes of this Order the commencement of the period when the vehicle on which it is displayed is left in a paying parking place by means of clear and appropriate indications by or on behalf of the driver of –

(a)     the month;

(b)     the date in the month;

(c)     except if it is a Sunday, the day of the week; and

(d)     the next succeeding 5 minute index within the hour of the day at which the vehicle was first left in the paying parking place;”.

3        Article 17 substituted

For Article 17 of the principal Order there shall be substituted the following Article –

“17    Use of parking card to indicate that charge has been paid

The payment of a charge shall be indicated by the display on the vehicle of a valid parking card.”.

4        Article 28 amended

For Article 28 of the principal Order there shall be substituted the following Article –

“28    Interpretation

In this Part –

‘business parking permit’ means a permit that permits parking in a zone only between the hours of 8 a.m. and 6 p.m.;

‘Cheapside Zone’ means the area bounded by thick red lines in the map labelled Map C in Part 1 of Schedule 9;

‘Connétable’ means the Connétable of St. Helier;

‘permit’ means a permit issued under Article 34 that is in force;

‘resident’s parking permit’ means a permit that permits parking in a zone at any time;

‘Richmond Road Zone’ means the area bounded by thick black lines in the map labelled Map B in Part 1 of Schedule 9;

‘St. Mark’s Zone’ means the area bounded by thick blue lines in the map labelled Map A in Part 1 of Schedule 9;

‘zone’ means the Richmond Road Zone, Cheapside Zone or St. Mark’s Zone.”.

5        Article 29 amended

In Article 29(2) and (3) of the principal Order for the words “Part 3 of Schedule 8” in each place where they occur there shall be substituted the words “Part 1, 2 or 3 of Schedule 8”.

6        Article 32 amended

For Article 32(1) of the principal Order there shall be substituted the following paragraph –

“(1)    Subject to paragraph (2), the fee payable for –

(a)     a resident’s parking permit in relation to any one zone, being the Cheapside Zone or the St. Mark’s Zone, shall be £200;

(b)     a resident’s parking permit in relation to the Richmond Road Zone shall be £100; or

(c)     a business parking permit in relation to any one zone shall be £150.”.

7        Article 33 amended

For Article 33(2) of the principal Order there shall be substituted the following paragraph –

“(2)    The Connétable may refuse to issue a resident’s parking permit if –

(a)     he or she is not satisfied that the applicant for the permit satisfies the criteria for an application for a permit specified in Article 30(1);

(b)     there are already in force, in relation to the zone to which the application for the permit relates, as many resident’s parking permits or business parking permits as there are parking places in the zone;

(c)     adequate parking facilities exist within the curtilage of the premises containing the applicant’s dwelling; or

(d)     the vehicle to which the application relates is a commercial vehicle the unladen weight of which exceeds 1,600 kg.”.

8        Schedule 1 amended

In Part 1 of Schedule 1 to the principal Order, opposite the entry relating to Lewis Street (between Kensington Street and Cheapside) in the first column, for the entry in the second column there shall be substituted the following entry –

“Cheapside to Kensington Street”.

9        Schedule 4 amended

In Schedule 4 to the principal Order –

(a)     opposite the entry relating to Cheapside in the first column, for the entry in the second column there shall be substituted the following entries –

“North side

South side (between St. Aubin’s Road and a point 5 yards south of the northern boundary of No. 19)

South side (between a point 25 yards south of the northern boundary of No. 19 and Kensington Place)”;

(b)     opposite the entry relating to Kensington Place in the first column, for the first entry in the second column there shall be substituted the following entries –

“North side (between the Esplanade and a point 22 yards south-west of the eastern corner of the Grand Hotel)

North side (between a point 10 yards south-west of the eastern corner of the Grand Hotel and a point 41 yards west of the eastern boundary of Central Apartments)”;

(c)     opposite the entry relating to Old St. John’s Road in the first column, for the second entry in the second column there shall be substituted the following entries –

“West side (from a point 29 yards north of Cheapside and a point 17 yards south of the north-east corner of the boundary of West Mount Park)

West side (between New St. John’s Road and the north-east corner of the boundary of West Mount Park)”;

(d)     opposite the entry relating to Parade Road in the first column, for the last entry in the second column there shall be substituted the following entry –

“South side (between St. John’s Road and a point 2 yards east of the northern corner of Le Verger Substation boundary)”.

10      Schedule 8 amended

(1)     In Part 1 of Schedule 8 to the principal Order –

(a)     opposite the entry relating to Lewis Street in the first column, for the entry in the second column there shall be substituted the following entry –

“South side (between a point 16 yards west of Cheapside and a point 11 yards further west)”;

(b)     opposite the entry relating to Old St. John’s Road in the first column, the second entry in the second column shall be deleted.

(2)     In Part 2 of Schedule 8 to the principal Order opposite the entry relating to Kensington Place in the first column, for the second entry in the second column there shall be substituted the following entry –

“North side (between the eastern boundary of No. 21 and a point 28 yards further east)”.

(3)     In Part 3 of Schedule 8 to the principal Order –

(a)     after the entries relating to Oxford Road there shall be inserted the following entries –

“Parade Road

South side (between West Park Avenue and a point 40 yards further west)

Peirson Road

South side (between a point 26 yards east of the Esplanade and a point 30 yards further east)

Roussel Street

South side (between a point 32 yards west of Rouge Bouillon and a point 14 yards further west)

 

South side (between a point 1 yard west of the eastern boundary of St. Mary’s Court and a point 27 yards further west)”;

 

(b)     at the end of the Part there shall be inserted the following entries –

“West Park Avenue

East side (from a point 6 yards south of the northern boundary of No. 1 eastwards for a distance of 17 yards)”.

(4)     In Part 4 of Schedule 8 to the principal Order the entries relating to Parade Road, Peirson Road, Roussel Street and West Park Avenue shall be deleted from both the first column and the second column.

11      Schedule 9 amended

In Schedule 9 to the principal Order –

(a)     in Part 1, for the heading to Map A there shall be substituted the heading “ST. MARK’S ZONE”;

(b)     in Part 1, for the heading to Map B there shall be substituted the heading “RICHMOND ROAD ZONE”;

(c)     in Part 1, after Map B there shall be inserted the map set out in Schedule 1 to this Order;

(d)     for Parts 2 and 3 there shall be substituted the Parts set out in Schedule 2 to this Order.

12      Schedule 10 amended

In Part 1 of Schedule 10 to the principal Order –

(a)     after the entries relating to Charing Cross there shall be inserted the following entries –

 

“Cheapside

South side (between a point 5 yards south of the northern boundary of No. 19 and a point 20 yards further south)

20 minutes

5 a.m. to 6 p.m.”;

(b)     the entries relating to Janvrin Road shall be deleted from the first, second, third and fourth columns;

(c)     at the end of the entries relating to Kensington Place in the second, third and fourth columns there shall be inserted the following entries –

 

“North side (between a point 10 yards south-west of the eastern corner of the Grand Hotel and a point 12 yards further south-west

20 minutes

5 a.m. to 6 p.m.”;

(d)     opposite the entry in the first column relating to Stopford Road, the second set of entries relating to that road in the second, third and fourth columns shall be deleted;

(e)     the entries relating to Westmount Road shall be deleted from the first, second, third and fourth columns.

13      Citation and commencement

This Order may be cited as the Road Traffic (St. Helier) (Amendment No. 22) (Jersey) Order 2008 and shall come into force on the fourteenth day after it is made.
