SOCIAL SECURITY (CLAIMS AND PAYMENTS) (AMENDMENT No. 3) (JERSEY) ORDER 2001

____________

 

                THE EMPLOYMENT AND SOCIAL SECURITY COMMITTEE, in pursuance of Articles 29, 36 and 51 of the Social Security (Jersey) Law 1974,[1] as amended,[2] orders as follows -

 

                1.      In this Order, “principal Order” means the Social Security (Claims and Payments) (Jersey) Order 1974,[3] as amended.[4]

 

                2.      In Article 7(2) of the principal Order, the words “for widowed mother’s allowance, widowed father’s allowance or” shall be deleted.

 

                3.-(1)  For the words “widow’s benefit, widowed father’s allowance” in Article 11(3) of the principal Order there shall be substituted the words “survivor’s benefit”.

 

                (2)     For the words “widow’s benefit, widowed father’s allowance” in Article 11(7) of the principal Order there shall be substituted the words “survivor’s benefit”.

 

                (3)     For the words “widow’s benefit, widowed father’s allowance” in Article 11(8) of the principal Order there shall be substituted the words “survivor’s benefit”.

 

                4.      For the words “widows benefit” in Article 13(4)(c) of the principal Order there shall be substituted the words “survivor’s benefit”.

 

                5.      For the words “Widow’s benefit” in the second column of the First Schedule to the principal Order there shall be substituted the words “Survivor’s benefit”.

 

                6.-(1)  For items 6, 6A and 6B in Part I of the Second Schedule to the principal Order there shall be substituted the following items -

 

“6.   Old age pension (not being a reduced old age pension under Article 25(1A) of the Law or an old age pension for a widow by virtue of the insurance of her husband in respect of whose death she was immediately before attaining pensionable age entitled to survivor’s pension) or increase of such an old age pension in respect of an adult dependant.

 

The period of three months from the date on which, apart from satisfying the condition of making a claim, the claimant becomes entitled thereto

Benefit in respect of any period more than three months before the date on which the claim is made

6A.  Reduced old age pension under Article 25(1A) of the Law or increase of such an old age pension in respect of an adult dependant.

 

The period of one month from the date on which, apart from satisfying the condition of making a claim, the claimant becomes entitled thereto

Benefit in respect of any period more than one month before the date on which the claim is made

6B.  Survivor’s benefit

The period of three months from the date on which, apart from satisfying the condition of making a claim, the claimant becomes entitled thereto.

Benefit in respect of any period more than three months before the date on which the claim is made.”.

 

                (2)     For the words “the date on which he will attain pensionable age” in paragraph 4(2) of Part II of the Second Schedule to the principal Order there shall be substituted the words “the date on which he will become entitled to an old age pension”.

 

                7.      The Social Security (Claims and Payments) (Amendment) (Jersey) Order 1976[5] shall be revoked.

 

                8.      This Order may be cited as the Social Security (Claims and Payments) (Amendment No. 3) (Jersey) Order 2001 and shall come into force on the first day of April 2001.
