THE STATES, in pursuance of Articles 50 and 51 of the Social Security (Jersey)
Law 1974[1], Article 3(3) of the Income
Support (Jersey) Law 2007[2] and, to the extent that these
Regulations amend the Cold Weather Bonus (Jersey) Regulations 2012[3], the Order in Council dated 28th
March 1771[4], have made the following
Regulations –
1 Interpretation
In these Regulations, apart from Regulations 8,
9 and 10, a reference to an Article or Schedule, or to a sub-division of an
Article or Schedule, by number is a reference to the Article, Schedule or
sub-division of that number in the Social Security (Jersey) Law 1974[5].
2 Article 1
amended
In Article 1(1) for the definition “pensionable
age” there shall be substituted the following definition –
“ ‘pensionable age’ shall be construed in
accordance with Article 1A;”.
3 Article 1A
inserted
After Article 1 there shall be inserted the following Article –
Schedule 1AA has effect
to specify what, in any person’s case, is the person’s pensionable age.”.
4 Article 8A
amended
In Article 8A –
(a) in paragraph (6)
for the words “divided by 45.” there shall be substituted the words
“divided by the number of contribution years specified in the
person’s case in Schedule 1AA.”;
(b) in paragraph (7)
for the words “45 years,” there shall be substituted the words
“the number of contribution years specified in the person’s case in
Schedule 1AA,”.
5 Article 25
amended
In Article 25(1A)(a) for the words “the age of 63;”
there shall be substituted the words “the reduced pension age specified
in the person’s case in Schedule 1AA;”.
6 Article 47
amended
(1) For
the heading to Article 47 there shall be substituted the heading “Class 2 insured persons nearing pensionable age”.
(2) In Article 47(1)
for the words “the age of 60 years” there shall be substituted
the words “the Class 2 contribution exception age specified in the
person’s case in Schedule 1AA”.
7 Schedule 1AA
inserted
Before Schedule 1A there shall be inserted the following
Schedule –
“SCHEDULE 1AA
(Articles 1A, 8A(6), 8A(7),
25(1A)(a) and 47(1))
pensionable age
1 Pensionable age
A person’s pensionable
age is the age specified in column 2 of the table, below, opposite the age
category specified in column 1 of the table in which the person’s
date of birth falls.
2 Contribution years under Article 8A
A person’s contribution
years, for the purposes of Article 8A(6) and (7), is the period specified
in column 3 of the table, below, opposite the age category specified in
column 1 of the table in which the person’s date of birth falls.
3 Election to take reduced
old age pension under Article 25
A person’s reduced
pension age, for the purposes of Article 25(1A)(a), is the age specified
in column 4 of the table, below, opposite the age category specified in
column 1 of the table in which the person’s date of birth falls.
4 Election in respect of
Class 2 contributions under Article 47
A person’s Class 2
contribution exception age, for the purposes of Article 47(1), is the age
specified in column 5 of the table, below, opposite the age category
specified in column 1 of the table in which the person’s date of
birth falls.

8 Health
Insurance (Jersey) Law 1967 amended
In Article 1(1) of the Health Insurance (Jersey) Law 1967[6] for the definition
“compulsory insurance age” there shall be substituted the following
definition –
“ ‘compulsory
insurance age’ means a person’s pensionable age, determined in
accordance with Article 1A of and Schedule 1AA to the Social Security
Law;”.
9 Income
Support (Jersey) Law 2007 amended
In Article 3(1) of the Income Support (Jersey) Law 2007[7] for sub-paragraph (a)
there shall be substituted the following sub-paragraph –
“(a) persons who have attained
their pensionable age, determined in accordance with Article 1A of and Schedule 1AA
to the Social Security (Jersey) Law 1974[8];”.
10 Cold
Weather Bonus (Jersey) Regulations 2012 amended
In Regulation 3(4) of the Cold Weather Bonus (Jersey) Regulations 2012[9] for the words “is aged
65 years or over” there shall be substituted the words “has
attained his or her pensionable age, determined in accordance with Article 1A
of and Schedule 1AA to the Social Security (Jersey) Law 1974[10],”.
11 Citation
and commencement
These Regulations may be cited as the Social Security (Amendment of
Law No. 7) (Jersey) Regulations 2014 and shall come into force one
month after they are made.
