THE EMPLOYMENT AND SOCIAL SECURITY COMMITTEE, in pursuance of Article 45
of the Social
Security (Jersey) Law 1974[1] and Article 18 of the
Social Security (Amendment No. 14) (Jersey) Law 2000,[2] orders as follows –
1 Interpretation
In this Order, “principal
Order” means the Social Security (Married Women) (Jersey)
Order 1974.[3]
2 Article
3 amended
(1) In
the heading to Article 3 of the principal Order, the words
“, ACCIDENT BENEFIT” shall be deleted.
(2) In
Article 3(1) of the principal Order, the words “, accident
benefit” shall be deleted.
3 Article
4 amended
For Article 4(1) of the principal Order there shall be
substituted the following paragraph –
“(1) Subject to the following
provisions of this Article, where a woman ceases to be entitled to
survivor’s allowance otherwise than by reason of re-marriage or cohabitation
with another person of either sex –
(a) she shall be deemed to have satisfied the
contribution conditions for short term incapacity allowance set out in sub-paragraph (1)(a)
of paragraph 1 of the Second Schedule to the Law;[4]
(b) she shall be deemed to have satisfied the
contribution conditions for long term incapacity allowance, incapacity pension
and old age pension set out in sub-paragraph (1)(a) of paragraph 2,
sub-paragraph (1)(a) of paragraph 3 and sub-paragraph (1)(a) of
paragraph 6 respectively of that Schedule.[5]”.
4 Revocation
Article 4(1) of the Social Security (Married Women) (Amendment
No. 2) (Jersey) Order 2001[6] is revoked.
5 Citation
and commencement
This Order may be cited as the Social Security (Married Women) (Amendment
No. 3) (Jersey) Order 2004 and shall come into force on 1st October
2004.
