Income Support (General Provisions) (Amendment No. 24) (Jersey) Order 2019

THE MINISTER FOR SOCIAL SECURITY makes this Order under Articles 2 and 18 of the Income Support (Jersey) Law 2007[1] –

1        Interpretation

In this Order “principal Order” means the Income Support (General Provisions) (Jersey) Order 2008[2].

2        Article 1 (interpretation) amended

In Article 1 of the principal Order, the definition “2007 Regulations” is deleted.

3        Article 5 (persons treated as being members of the same household) amended

For Article 5(2)(c) of the principal Order, there is substituted –

“(c)    does not meet the criteria for –

(i)      the rate payable in respect of the personal care element of the impairment component under paragraph 6(3)(b), 6(3)(c) or 6(4) of Schedule 1 to the Regulations, or

(ii)      the weekly rate set for the lowest level of standard care for which provision is made under Article 8 of the Long-Term Care (Benefits) (Jersey) Order 2014[3].”.

4        Article 12 (functions of determining officers) amended

In Article 12(1A)(a), (b), (c) and (d) of the principal Order, “2007” is deleted.

5        Article 13 (right to redetermination by second determining officer) amended

In Article 13A(4A)(c) of the principal Order, “2007” is deleted.

6        Schedule 2 (calculated income) amended

In Schedule 2 to the principal Order –

(a)     for paragraph 2(2)(f), there is substituted –

“(f)    for as long as the criteria in either clause (i) or (ii) is met, any capital that has been accumulated solely to provide for the future care of a member of a household who meets the criteria for –

(i)      the rate of personal care element of the impairment component for which provision is made under paragraph 6(3)(c) or 6(4) of Schedule 1 to the Regulations, or

(ii)      the rate of long-term care benefit for which provision is made under Article 8 of the Long-Term Care (Benefits) (Jersey) Order 2014.”.

(b)     in the following places, for “25%” there is substituted “26%” –

(i)      paragraph 5(a),

(ii)      paragraph 5(d),

(iii)     paragraph 5(f), wherever occurring.

7        Citation and commencement

This Order may be cited as the Income Support (General Provisions) (Amendment No. 24) (Jersey) Order 2019 and comes into force on 1st October 2019.
