States of Jersey (Ministerial Offices) Order 2022

THE CHIEF MINISTER makes this Order under Article 29A of the States of Jersey Law 2005 –

1        Current list of Ministerial offices

In addition to the Chief Minister, the Ministers are –

the Minister for Children and Education;

the Minister for Economic Development, Tourism, Sport and Culture;

the Minister for the Environment;

the Minister for External Relations and Financial Services;

the Minister for Health and Social Services;

the Minister for Home Affairs;

the Minister for Housing and Communities;

the Minister for Infrastructure;

the Minister for International Development;

the Minister for Social Security;

the Minister for Treasury and Resources.

2        Construing references to Committees and Ministers in UK extended legislation

Schedule 1 provides for construing certain references to Committees and Ministers in UK extended legislation, within the meaning of the Legislation (Jersey) Law 2021, in relation to transferred functions and renamed Ministerial offices.

3        Spent Regulations and Orders that transferred functions or established or renamed Ministers

(1)     The Regulations and Orders set out in Schedule 2 are to be treated as amended to apply Article 29A(4) to (9) of the States of Jersey Law 2005 to them and to disapply any provision to the extent that it is not compatible with that Article.

(2)     The States of Jersey (Minister for External Relations and Financial Services) (Jersey) Regulations 2013 are to be treated as amended to apply Article 29A(4) to (6) of the States of Jersey Law 2005 to them and to disapply any provision to the extent that it is not compatible with that Article.

(3)     As a result of the consolidation effected by paragraph (1) and by Article 1, the Regulations and Orders set out in Schedule 2 are to be treated as spent on the commencement of this Order to any extent that they are not already spent.

(4)     In the States of Jersey (Minister for International Development and Minister for Children and Housing) (Jersey) Order 2018 –

(a)     Article 2 is to be treated as spent (as a result of the consolidation effected by Article 1 of this Order);

(b)     in Article 6 “and Minister for Children and Housing” is deleted.

4        Citation and commencement

This Order may be cited as the States of Jersey (Ministerial Offices) Order 2022 and comes into force 7 days after it is made.

Schedule 1

(Article 2)

UK EXTENDED LEGISLATION – CONSTRUING REFERENCES TO COMMITTEES AND MINISTERS

1        Aviation Security (Jersey) Order 1993 construed

In the Aviation Security (Jersey) Order 1993 –

(a)     the references to the Committee in the following provisions are construed as references to the Minister for Economic Development, Tourism, Sport and Culture –

(i)      section 21(6)(a) of the Aviation Security Act 1982 as extended to Jersey,

(ii)      the definition “Airport Director” in section 38(1) of that Act;

(b)     all other references to the Committee are construed as references to the Minister for External Relations and Financial Services.

2        Broadcasting Orders in Council construed

The following references are construed as references to the Minister for Economic Development, Tourism, Sport and Culture –

(a)     a reference to the States of Jersey Broadcasting Committee in the Broadcasting Act 1990 (Jersey) (No. 2) Order 1991;

(b)     a reference to the Economic Development Committee of the States of Jersey or the Broadcasting Committee of the States of Jersey in the Broadcasting (Jersey) Order 2003.

3        Civil Aviation Orders in Council construed

In each of the following Orders in Council, a reference to the Committee is construed as a reference to the Minister for External Relations and Financial Services –

(a)     the Civil Aviation Act 1982 (Jersey) Order 1990;

(b)     the Civil Aviation Act 1982 (Jersey) (Amendment) Order 1998;

(c)     the Civil Aviation (Investigation of Air Accidents and Incidents) (Jersey) Order 2000.

4        Communications (Jersey) Order 2003 construed

In the Communications (Jersey) Order 2003 a reference to the Economic Development Committee of the States of Jersey is construed as a reference to the Minister for Economic Development, Tourism, Sport and Culture and the reference to any other Committee of the States is construed as a reference to any other Minister.

5        Nuclear Safeguards (Jersey) Order 2004 construed

In the Nuclear Safeguards (Jersey) Order 2004 a reference to the Policy and Resources Committee is construed as a reference to the Minister for External Relations and Financial Services.

6        Telecommunication Services (Jersey) Order 1972 construed

In the Telecommunication Services (Jersey) Order 1972 a reference to the States Telecommunications Board is construed as a reference to the Minister for Economic Development, Tourism, Sport and Culture.

7        Wireless Telegraphy (Jersey) Order 2006 construed

In the Wireless Telegraphy (Jersey) Order 2006 a reference to the Minister for Economic Development is construed as a reference to the Minister for Economic Development, Tourism, Sport and Culture.
