THE MINISTER FOR TRANSPORT AND TECHNICAL SERVICES, in pursuance of Articles 21 and
84 of the Road Traffic (Jersey) Law 1956[1], orders as follows –
1 Interpretation
In this Order “principal Order” means the Road Traffic
(Speed Limits) (Jersey) Order 2003[2].
2 Article
1 substituted
For Article 1 of the principal Order there shall be substituted
the following Article –
‘road’ includes
part of a road;
‘speed limit’
means the maximum speed at which a motor vehicle may be driven.”.
3 New
Articles 4A to 4C
After Article 4 there shall be inserted the following
Articles –
Notwithstanding any provision
of this Order to the contrary, a motor vehicle shall not be driven on any road
at a speed exceeding that indicated by a traffic sign –
(a) placed and operated by the Minister in
accordance with Article 4B or 4C;
(b) during any period when the traffic sign is
in operation; and
(c) from when the vehicle has passed that
traffic sign until it has passed a traffic sign indicating the end of the speed
limit or the beginning of a different speed limit.
(a) may be placed no further than
500 metres from any pedestrian access to a school; and
(b) may operate –
(i) at
any time between the hours of 8 a.m. and 5.30 p.m. on any day when
the school is open to children, and
(ii) at
any other time when the school is open to children.
(2) A traffic sign placed and operated in
accordance with paragraph (1) shall –
(a) comply with Article 28A of the Traffic
Signs (Jersey) Order 1968[3]; and
(b) indicate a speed limit of 20 miles per hour.
(1) A traffic sign may be placed no further than
100 metres from any works that are being executed on or in the vicinity of
a road until the works are completed, and when so placed shall be in permanent
operation.
(2) A traffic sign placed in accordance with
paragraph (1) shall indicate the speed limit that applies to the road or
roads concerned.”.
4 Citation
and commencement
This Order may be cited as the Road Traffic (Speed Limits)
(Amendment No. 3) (Jersey) Order 2008 and shall come into force 7 days
after it is made.
