THE MINISTER FOR THE ENVIRONMENT makes this Order under Articles 2(2),
7(1), 31A and 32 of the Animal Health (Jersey) Law 2016[1], Article 39A
of the Animal Welfare (Jersey) Law 2004[2] and Regulation 9 of the EU Legislation
(Monitoring of Residues in Animals) (Jersey) Regulations 2019[3] –
1 Artificial Insemination of Domestic Animals (Bovine Semen) (Jersey)
Order 2008 amended
In Article 1(2) of
the Artificial Insemination of Domestic Animals (Bovine Semen) (Jersey) Order
2008[4] for “as in force on the date this Order comes into force” there is
substituted “as amended from time to time”.
2 Animal Health (Importation of Miscellaneous Goods and
Animals) (Jersey) Order 2017 amended
In the Schedule to the
Animal Health (Importation of Miscellaneous Goods and Animals) (Jersey) Order
2017[5] for the list of animals in the second column in relation to prohibition
number 5 there is substituted “Antilocapridae,
Camelidae, Caprinae, Cervidae, Elephantidae, Giraffidae, Hippopotamidae, Rhinocerotidae, Suidae, Tayassuidae
and Tragulidae.”.
3 Animal Health (Jersey) Law 2016 amended
In Schedule 1 to the
Animal Health (Jersey) Law 2016[6] after “Dourine” there is inserted “Ebola in non-human primates”.
4 Diseases of Animals (Bees) (Jersey) Order 2013 amended
In Article 14 of the
Diseases of Animals (Bees) (Jersey) Order 2013[7] –
(a) in paragraph (3) for
“as amended up to 1st March 2012” there is substituted “as amended from time to
time”;
(b) in paragraph (5), in
the definition “Commission Regulation”, for “as amended up to 28th March 2013”
there is substituted “as amended from time to time”.
5 Community Provisions (Bovine Embryos)
(Jersey) Regulations 2010 amended
In the Community
Provisions (Bovine Embryos) (Jersey) Regulations 2010[8] –
(a) in Regulation 1 for the
definition “border inspection post” there is substituted –
“ “border inspection post” means an inspection post designated and
approved in accordance with Article 6 of Council Directive 91/496/EEC
of 15 July 1991 laying down the principles governing the organization
of veterinary checks on animals entering the Community from third countries (OJ L 268, 24.9.1991, p.56),
as amended from time to time;”;
(b) in Regulation 1 for
the definition “Community Provision” there is substituted –
“ “Community Provision” means Council Directive 89/556/EEC of 25 September 1989
on animal health conditions governing intra-Community trade in and importation
from third countries of embryos of domestic animals of the bovine species (OJ L 302, 19.10.1989, p.1),
as amended from time to time;”;
(c) for Regulation 15(2)
there is substituted –
“(2) An unlisted third country is one that does
not appear in Annex I to Commission Decision 2006/168/EC of 4 January 2006
establishing the animal health and veterinary certification requirements for
imports into the Community of bovine embryos (OJ L 57,
28.2.2006, p.19), as amended from time to time.”;
(d) for Regulation 16(2)(b)
there is substituted –
“(b) the veterinary checks required by Council
Directive 97/78/EC of 18 December 1997 laying down the
principles governing the organisation of veterinary checks on products entering
the Community from third countries (OJ L 24,
30.1.1998, p.9), as amended from time to time, are
conducted at the border inspection post.”.
6 European Communities Legislation (Implementation) (Cattle Identification)
(Jersey) Regulations 2002 amended
In the European
Communities Legislation (Implementation) (Cattle Identification) (Jersey)
Regulations 2002[9] –
(a) in Regulation 1(1), in
the definition “cattle passport”, for “2629/97” there is substituted “911/2004”;
(b) in Regulation 1(2) for “2629/97” there is substituted “911/2004”;
(c) after Regulation 1(2) there is inserted –
“(3) In these Regulations a reference to an EU
instrument is to be read as a reference to that EU instrument as amended from
time to time.”;
(d) in Regulations 2(2),
3(2), 3(4), 12(5), 13(2) and 14(1) for “2629/97” there is substituted “911/2004”.
7 Citation and commencement
This Order may be cited
as the Animal Health and Welfare (EU – Miscellaneous Amendments) (Jersey)
Order 2019 and comes into force 14 days after it is made.
