Traffic (Miscellaneous Amendments – Electric Vehicle Parking) (Jersey) Order

THE MINISTER FOR INFRASTRUCTURE, after consultation with the Connétable of St. Helier, makes this Order under
Articles 62, 63, 64, 72 and 84 of the Road Traffic
(Jersey) Law 1956 –
1 Road Traffic (St. Helier)
(Jersey) Order 1996 amended
This Order amends the Road Traffic (St. Helier) (Jersey) Order
1996.
2 Article 2 (interpretation) amended
In Article 2(1),
after the definition “Connétable” there is
inserted –
“ “electric vehicle” means
a vehicle that is powered solely by an electric motor;”.
3 Article 10 (interpretation) amended
In Article 10(1) –
(a) in the definition
“parking” –
(i) in sub-paragraph (b),
for “Part 3A, 4, 6, 7 or 8” there is substituted “Part 3A, 4 or 6”,
(ii) after sub-paragraph (d),
there is inserted –
“(da) at a parking place specified
in Part 16 of Schedule 8 –
(i) at any time, for the
purposes of Article 27C, and
(ii) between the hours of 9 a.m.
and 10 p.m. on any day, for all other purposes;”;
(b) in the definition
“vehicle”, for “Article 20(3) and in paragraph (4) of that Article in
so far as it applies to Part 8 of Schedule 8 and in Article 26”
there is substituted “Article 26”.
4 Article 11 (designation of paying
parking places) amended
In Article 11 –
(a) in paragraph (1),
for “Parts 1, 2 and 3” there is substituted “Parts 1, 2, 3 and 16”;
(b) in paragraph (2),
“paragraph (4) and” is deleted;
(c) in paragraph (3),
for “Part 1, 2 or 3” there is substituted “Parts 1, 2, 3 and 16”;
(d) after paragraph (3)(c)
there is inserted –
“(d) in respect of a paying
parking place specified in Part 16 – 2 hours.”.
5 Article 20 (parking of vehicles
displaying parking discs) amended
In Article 20 –
(a) in paragraph (1) –
(i) “paragraph (5) and”
is deleted,
(ii) for “Part 3A, 3B,
4, 6 or 7” there is substituted “Part 3A, 3B, 4 or 6”;
(b) in paragraph (2) –
(i) for “Part 3A, 3B, 4, 6 or 7” there is
substituted “Part 3A, 3B, 4 or 6”,
(ii) paragraph (d) is deleted;
(c) paragraph (3) is deleted;
(d) in paragraph (4) –
(i) for “Part 3A, 3B 4, 6, 7 or 8” there is
substituted “Part 3A, 3B, 4 or 6”,
(ii) for “paragraph (2)
or (3)” there is substituted “paragraph (2)”.
6 Article 21 (indication of time on, and
display of, parking discs) amended
In Article 21(1) and
(2), for “Part 3A, 3B, 4, 6, 7 or 8” there is substituted “Part 3A,
3B, 4 or 6”.
7 Article 21A (restriction on returning to
parking place) amended
In Article 21A(1),
for “Part 1, 2, 3, 3A, 3B, 4, 5, 6, 7 or 8” there is substituted “Part 1,
2, 3, 3A, 3B, 4 or 6”.
8 Article 27B (car club permit) amended
In Article 27B(1),
the definition “electric vehicle” is deleted.
9 Article 27C (electric vehicle parking) inserted
After Article 27B
(car club permit) there is inserted –
“27C Electric vehicle parking
“electric vehicle recharging bay” means a parking
place –
(a) specified in Part 16
of Schedule 8; and
(b) indicated by signs or
road markings authorised by the Minister;
“electric vehicle recharging point” means a
purpose-built unit –
(a) designed solely for the
purpose of charging an electric vehicle; and
(b) permitted by the Minister
for use on the public highway.
(2) A
vehicle must not be parked in an electric vehicle recharging bay at any time unless –
(a) the vehicle is an
electric vehicle; and
(b) the vehicle is connected
to an electric vehicle recharging point.”.
10 Schedule 8 (parking places on roads) amended
(1) In
Part 15 (car club permit parking) of Schedule 8, for the item “Parade,
The (eastern arm)” in the first column and its entry
in the second column there is substituted –

“Esplanade
|
North side (between a point 99 yards
east of its junction with Castle Street and a point 13 yards further
east)”.
|
(2) After
Part 15 there is inserted –
“Part 16
(Article 27C)
Electric vehicle parking – Paying parking places 2 hour limit
between 9 a.m. and 10 p.m.
|
Parade, The (eastern arm)
|
West side (between a point 18 yards
north of its junction with Union Street and a point 10 yards further
north)”.

11 Citation and commencement
This Order may be cited
as the Road Traffic (Miscellaneous Amendments –
Electric Vehicle Parking) (Jersey) Order 2023 and comes into force 7 days
after it is made.
