1 Amendment of the Royal Court Rules 2004
These Rules amend the Royal
Court Rules 2004.
2 Part 1 amended
(1) In
Rule 1/1(1) after the definition of “Court” there is inserted –
(2) After
Rule 1/1 there is inserted –
These Rules apply to all causes or matters other than proceedings to
which Criminal Procedure Rules apply.”.
(3) In
Rule 1/6, paragraph (8) is deleted.
3 Part 3 amended
(1) In
Rule 3/1(2)(f) “(other than in criminal or quasi-criminal proceedings)” is
deleted.
(2) Rule
3/5 is deleted.
4 Part 5 amended
In Rule 5/4,
sub-paragraph (d) is deleted.
5 Part 6 amended
(1) In
Rule 6/1 “or to criminal or quasi-criminal proceedings” is deleted.
(2) In
Rule 6/20 –
(a) for paragraph (4)
there is substituted –
“(4) The Court may at all events, and whether or
not an order is made under sub-paragraph (2)(a), order the production of a
witness for cross-examination.”;
(b) in paragraph (5)(a)
“, other than in criminal or quasi-criminal proceedings,” is deleted;
(c) paragraph (6) is
deleted; and
(d) in paragraph (7) “or
(6)” is deleted.
(3) Rule
6/38 is deleted.
6 Part 10 amended
(1) In
Rule 10/1 –
(a) in the heading “(Civil proceedings)”
is deleted;
(b) in the Rule “civil” is
deleted.
(2) Rule
10/2 is deleted.
(3) In
Rule 10/3 for “civil proceedings before the Court” there is substituted
“proceedings to which these Rules apply”.
7 Part 16 amended
(1) In
the heading to Part 16 “IN CIVIL PROCEEDINGS” is deleted.
(2) In
Rule 16/1, paragraph (4) is deleted.
8 Schedule 1 amended
In Schedule 1, the
entry referring to Rule 10/2 is deleted.
9 Citation and commencement
These Rules may be cited
as the Royal Court (Amendment No. 26) Rules 2021 and come into force on
1st October 2021.
