MOTOR TRAFFIC (No. 7) (JERSEY) REGULATIONS 2001

THE STATES, in pursuance of the powers conferred on them by the Order in
Council of the twenty-sixth day of December 1851, and by Article 54A of the Motor Traffic (Jersey)
Law 1935, as amended (in these Regulations called “the Law”), have made the following
Regulations -
1.-(1) For Article 23(1) of
the Law there shall be substituted the following paragraphs -
“(1) Any application to the Committee for the
grant of a road service licence shall contain such particulars as may be
prescribed.
(1A) Subject
to the provisions of this Article and of any relevant orders under Article 24
of this Law, the Committee may -
(a) refuse
an application under paragraph (1) of this Article;
(b) grant
the applicant a road service licence on the terms sought by the applicant; or
(c) grant
the applicant a road service licence on such other terms as the Committee
thinks fit.”.
(2) After Article 23(2) of the Law there shall be inserted the following paragraph -
“(2A) In
having regard to the matters it is required to consider under
paragraph (2) of this Article, the Committee shall take into account any
relevant traffic and transportation policies and plans of the States.”.
(3) For Article 23(5) of the Law there shall be substituted the following paragraph -
“(5) On the application of the holder of a road
service licence for the variation of any condition of the licence, the
Committee may -
(a) refuse the application;
(b) grant
the application on the terms sought by the applicant; or
(c) grant
the application on such other terms as the Committee thinks fit.”.
2. In
Article 26(1)(a) of the Law, after the words “or with any conditions attached thereto” there
shall be inserted the words “or with any other terms of the licence”.
3. These
Regulations may be cited as the Motor Traffic (No. 7) (Jersey) Regulations
2001 and shall come into force on the day following promulgation.
