Road Traffic (Saint Helier) (Amendment No. 15) (Jersey) Order 2003

THE ENVIRONMENT AND PUBLIC SERVICES COMMITTEE, in pursuance of Articles 33, 33A, 33B and 42 of the Road Traffic (Jersey) Law 1956[1] and after consultation with the Connétable of St. Helier, orders as follows –

1        Interpretation

In this Order “principal Order” means the Road Traffic (Saint Helier) (Jersey) Order 1996.[2]

2        Article 10 amended

In Article 10(1) of the principal Order[3] for the definition “parking” there shall be substituted the following definition –

“ ‘parking’ means leaving a vehicle, whether attended or unattended –

(a)     between the hours of 8 a.m. and 5 p.m. on any day other than a Sunday, at a paying parking place;

(b)     between the hours of 8 a.m. and 5.30 p.m. on any day other than a Sunday, on any road specified in Part III, IV, V or VI of the Eighth Schedule;

(c)     between the hours of 5 p.m. and 10 p.m. on any day other than a Sunday and between the hours of 9 a.m. and 10 p.m. on a Sunday, on any road specified in Part IIIA of the Eighth Schedule;

(d)     on any road specified in Part XI of the Eighth Schedule; or

(e)     at a parking place specified in Part II of the Ninth Schedule,

and includes stopping a vehicle to load or unload goods or merchandise, but does not include stopping a vehicle to set down or pick up passengers, and ‘park’ and ‘parked’ shall be construed accordingly;”.

3        Article 20 amended

In Article 20 of the principal Order[4] –

(a)     at the beginning of paragraph (1) there shall be inserted the words “Subject to Article 29,”;

(b)     in paragraphs (1), (4) and (5) after the words “Part III,” there shall be inserted the word “IIIA,”;

(c)     in paragraph (2)(a) for the words “Part III” there shall be substituted the words “Parts III and IIIA”;

(d)     at the beginning of paragraph (4) there shall be inserted the words “Subject to Article 29,”;

(e)     at the beginning of paragraph (5) there shall be inserted the words “Except for a vehicle which is parked in accordance with Article 29,”.

4        Article 21 amended

In paragraphs (1) and (2) of Article 21 of the principal Order[5] –

(a)     at the beginning there shall be inserted the words “Subject to Article 29,”;

(b)     after the words “Part III,” there shall be inserted the word “IIIA,”.

5        Article 29 amended

In Article 29 of the principal Order[6] –

(a)     in paragraph (2) –

(i)      for the words “and 15,” there shall be substituted the words “14, 15, 20 and 21,”,

(ii)      after the words “within the zone” there shall be inserted the words “or on a road specified in Part IIIA of the Eighth Schedule which is within the zone”,

(iii)     for the word “parked” there shall be substituted the word “left”;

(b)     for paragraph (3) there shall be substituted the following paragraph –

“(3)    Notwithstanding the provisions of Article 11 and 20, a vehicle which is not displaying a permit may not be parked between the hours of 10 p.m. and 9 a.m. on any day –

(a)     in a paying parking place specified in Part IIA of the Eighth Schedule which is within the zone; or

(b)     on a road specified in Part IIIA of the Eight Schedule which is within the zone.”.

6        Eighth Schedule amended

After Part III of the Eighth Schedule[7] there shall be inserted the following Part –

 

“PART IIIA

 

(Article 20(1) and (2)(a))

 

Parking DISCS (EVENINGS AND SUNDAY) – 2 hour limit

 

Stopford Road

 

North side (from a point 12 yards west of its junction with Byron Road west for a distance of 19 yards)

 

 

North side (from a point 7 yards east of Byron Road eastwards for a distance of 7 yards)

 

 

South side (from the western boundary of No. 72 west for a distance of 13 yards)

 

 

South side (from the eastern boundary of No. 38 west for a distance of 13 yards)

Chevalier Road

 

East side (from its junction with Gas Place north to the northern boundary of No. 7)

 

 

East side (from its junction with Stopford Road south to the northern boundary of No. 41)

Oxford Road

 

East side (from the southern boundary of No. 21 north to the northern boundary of No. 23)

 

 

 

East side (from the northern boundary of No. 53 northwards to a point 6 yards south of the northern boundary of No. 57)

 

 

East side (from its junction with Byron Lane south to the southern boundary of No. 61)

St. Marks Road

 

North side (from a point 13 yards east of its junction with David Place eastwards for a distance of 60 yards).

 

 

North side (from its junction with Oxford Road eastwards for a distance of 52 yards).

Janvrin Road

 

West side (from its junction with Stopford Road north for a distance of 22 yards)”.

7        Citation and commencement

This Order may be cited as the Road Traffic (Saint Helier) (Amendment No. 15) (Jersey) Order 2003 and shall come into force on 5th November 2003.
