Income Support (General Provisions) (Amendment No. 18) (Jersey) Order 2015

THE MINISTER FOR SOCIAL SECURITY, in pursuance of Articles 7 and 18 of the Income Support (Jersey) Law 2007[1], orders as follows –

1        Schedule 2 to the Income Support (General Provisions) (Jersey) Order 2008 amended

In Schedule 2 to the Income Support (General Provisions) (Jersey) Order 2008[2] –

(a)     in paragraph 5(a) the words “who are not entitled to a basic component under Article 5(2)(b) of the Law” shall be deleted;

(b)     paragraphs 5(c), (e) and (h) shall be deleted;

(c)     in paragraph 5(d), for the word “10%” there shall be substituted the word “23%”;

(d)     for paragraphs 5(f) and (g) there shall be substituted the following sub-paragraphs –

“(f)    in the case where –

(i)      a household with a person who has attained pensionable age is in receipt of income support before 1st January 2016, or is the subject of an application for income support made before 1st January 2016 which is approved after that date, and

(ii)      after 1st January 2016 there is no period exceeding 28 days during which that household is not entitled to receive income support,

100% of the first £55.23 of any income derived from the pension or annuity of one such person in the household and 100% of the first £35.77 of any income derived from the pension or annuity of each other person in the household who has attained pensionable age;

(g)     in a case after 1st January 2016, where sub-paragraph (f) does not apply –

(i)      23% of the first £240.13 of any income derived from the pension or annuity of one person in the household who has attained pensionable age, and

(ii)      23% of the first £155.52 of any income derived from the pension or annuity of each other person in the household who has attained pensionable age;”;

(e)     for paragraph 5(ga) there shall be substituted the following sub-paragraph –

(ga)    23% of any income in excess of £240.13 derived from the pension or annuity of a person in the household who has attained pensionable age and 23% of any income in excess of £155.52 derived from the pension or annuity of each other person in the household who has attained pensionable age;”.

2        Citation and commencement

This Order may be cited as the Income Support (General Provisions) (Amendment No. 18) (Jersey) Order 2015 and shall come into force on 1st January 2016.
