Traffic (Lighting) (Amendment) (Jersey) Order 2020

THE MINISTER FOR INFRASTRUCTURE makes this Order under Articles 80
and 84 of the Road Traffic (Jersey) Law 1956[1] –
1 Interpretation
In this Order, “principal
Order” means the Road Traffic (Lighting) (Jersey) Order 1998[2].
2 Article 13 (lamps to show a steady light) amended
After Article 13(2)(f)
of the principal Order there is inserted –
“(g) a front or rear position lamp capable of
emitting a flashing light (whether or not it is also capable of emitting a
steady light) fitted to –
(i) a pedal cycle, or
(ii) a trailer drawn by, or a sidecar attached
to, a pedal cycle.
(3) In the case of a front position lamp
referred to in paragraph (2)(g) which is required to be fitted under
Article 19, it must be capable, when emitting a flashing light, of
emitting a flashing light to the front of the pedal cycle, trailer or sidecar
(as the case may be) of an intensity of not less than 4 candelas.
(4) In the case of a rear position lamp
referred to in paragraph (2)(g) which is required to be fitted under
Article 19, it must be capable, when emitting a flashing light, of
emitting a flashing light to the rear of the pedal cycle, trailer or sidecar
(as the case may be) of an intensity of not less than 4 candelas.”.
3 Article 19 (obligatory lamps, reflectors, rear markings
and devices) amended
In Article 19 of the
principal Order –
(a) in paragraph (1)
after “paragraph (2),” there is inserted “(2A) and (2B),”;
(b) after paragraph (2)
there is inserted –
“(2A) Except in the case of a lamp which is also capable
of emitting a steady light, the requirements specified in paragraph 5(c)
and (d) in the Table in Part 1 of Schedule 2 do not apply in the case
of a front position lamp which is capable of emitting a flashing light fitted
to –
(a) a pedal cycle; or
(b) a trailer drawn by, or a
sidecar attached to, a pedal cycle.
(2B) Except in the case of a lamp which is also
capable of emitting a steady light, the requirements specified in paragraph 5(d)
and (e) in the Table in Part 1 of Schedule 10 do not apply in the
case of a rear position lamp capable of emitting a flashing light fitted to –
(a) a pedal cycle; or
(b) a trailer drawn by, or a
sidecar attached to, a pedal cycle.”.
4 Schedule 2 (front position lamps) amended
In the Table in Part 1
of Schedule 2 to the principal Order, after paragraph 12(b) there is
inserted –
“(c) in the case of a front position lamp capable
of emitting a flashing light fitted to –
(i) a pedal cycle, or
(ii) a trailer drawn by, or a
sidecar attached to, a pedal cycle,
the light shown by the lamp when flashing must be displayed not less
than 60 nor more than 240 equal times per minute and the intervals
between each display of lights must be constant.”.
5 Schedule 10 (rear position lamps) amended
In the Table in Part 1
of Schedule 10 to the principal Order, in paragraph 12 –
(a) the existing text after
“Other requirements –” is numbered sub-paragraph (a);
(b) after
sub-paragraph (a) there is inserted –
“(b) in the case of a rear position lamp capable
of emitting a flashing light fitted to –
(i) a pedal cycle, or
(ii) a trailer drawn by, or a
sidecar attached to, a pedal cycle,
the light shown by the lamp when flashing must be displayed not less
than 60 nor more than 240 equal times per minute and the intervals between each
display of lights must be constant.”.
6 Citation and commencement
This Order may be cited
as the Road Traffic (Lighting) (Amendment) (Jersey) Order 2020 and comes into
force 7 days after the day it is made.
