(Amendment No. 15) Rules 2012

THE SUPERIOR NUMBER OF THE ROYAL COURT, in pursuance of Article 13
of the Royal Court (Jersey) Law 1948[1] and the Schedule to the Money
Laundering and Weapons Development (Directions) (Jersey) Law 2012[2], has made the following Rules –
1 Interpretation
In these Rules “principal Rules”
means the Royal Court Rules 2004[3].
2 Part
16A amended
(1) In
the heading to Part 16A of the principal Rules, for the words
“(JERSEY) LAW 2011” there shall be substituted the words
“AND THE MONEY LAUNDERING AND WEAPONS DEVELOPMENT LAWS”.
(2) In
Rule 16A/1 of the principal Rules –
(a) in
paragraph (1), for sub-paragraph (b) there shall be substituted the
following sub-paragraph –
“(b) any application to the Court –
(i) under
Article 29(2) of the 2011 Law, or
(ii) under
Article 10(1) of the 2012 Law.”;
(b) in
paragraph (4) –
(i) after the
definition of “2011 Law” there shall be inserted the following
definition –
“ ‘2012 Law’
means the Money Laundering and Weapons Development (Directions) (Jersey)
Law 2012[4];”;
(ii) in the definition
of “special counsel”, for the words “Schedule 1 to the
2011 Law” there shall be substituted the words “the Schedule
to the 2011 Law or under paragraph 5 of the Schedule to the
2012 Law as the case may be”.
(3) In
Rules 16A/2 and 16A/3 of the principal Rules, in the heading, the words
“under Article 28(2)” shall be
deleted.
(4) In
Rules 16A/4, 16A/5 and 16A/6 of the principal Rules, in the heading, the
words “under Article 29(2)”
shall be deleted.
(5) In
Rule 16A/8 of the principal Rules, in paragraph (1) the words
“under paragraph 5 of Schedule 1 to the 2011 Law”
shall be deleted.
3 Citation
and commencement
(1) These
Rules may be cited as the Royal Court (Amendment No. 15) Rules 2012.
(2) These
Rules shall come into force on the seventh day after they are made.
