Transport and Technical Services (Driver and Vehicle Standards - 2010 Fees and Miscellaneous Provisions) (Jersey) Order 2009

THE MINISTER FOR TRANSPORT AND TECHNICAL SERVICES, in pursuance of Articles 29 and 46 of the Motor Traffic (Jersey) Law 1935[1], Articles 4, 7, 8, 10 and 16 of the Motor Vehicle Registration (Jersey) Law 1993[2] and Articles 6, 7, 8, 77, 78 and 84 of the Road Traffic (Jersey) Law 1956[3], orders as follows –

2010 fees

1        Motor Traffic (Public Service Vehicles) (Fees) (Jersey) Order 2008 amended

In Article 2 of the Motor Traffic (Public Service Vehicles) (Fees) (Jersey) Order 2008[4] for paragraph (5) there shall be substituted the following paragraph –

“(5)    The fee for an application for a badge to drive a public service vehicle under Article 29 of the Law is a composite fee comprising –

(a)     in every case, £9.65;

(b)     in the case of a cab, if the applicant for the badge is required to pass a driving assessment test to satisfy the Inspector that the applicant is capable of safely driving a vehicle of that type, £78.55;

(c)     in the case of a cab, if the applicant for the badge is required to pass a knowledge test to satisfy the Inspector that the applicant has an adequate knowledge of Jersey, £62.30;

(d)     in the case of a char-à-banc, if the applicant for the badge is required to pass a knowledge test to satisfy the Inspector that the applicant has an adequate knowledge of Jersey, £42.30.”.

2        Motor Vehicle Registration (General Provisions) (Jersey) Order 1993 amended

In the Motor Vehicle Registration (General Provisions) (Jersey) Order 1993[5], in the provision described in column one of the following table, for the amount specified in column 2 there shall be substituted the amount specified in column 3 –

3        Motor Cars (Driving Instruction) (Jersey) Order 1982 amended

For Article 7 of the Motor Cars (Driving Instruction) (Jersey) Order 1982[6] there shall be substituted the following Article –

(1)     A person applying to submit himself or herself to the written part of the examination shall pay a fee of £80.20.

(2)     A person applying to submit himself or herself to the practical part of the examination shall pay a fee of £80.20.

(3)     The fee to be paid by a person who applies for the retention of his or her name in the register for a further period of 4 years shall be £159.70.

(4)     The fee to be paid by a person who applies for the entry of his or her name in the register shall be £159.70.”.

4        Motor Vehicles (Construction and Use) (Jersey) Order 1998 amended

In Article 2 of the Motor Vehicles (Construction and Use) (Jersey) Order 1998[7] for paragraph (7) there shall be substituted the following paragraph –

“(7)    For the purposes of Article 78(3) of the Law, the fee to accompany an application for a licence authorizing the use of a vehicle not complying with Orders under Article 77 of the Law shall be –

(a)     if the application is for a licence for the use of the vehicle on a specified journey or for a specified purpose or for a period of not more than 12 months, £80.20;

(b)     if the application is for a licence for the use of the vehicle in any other case, £143.65;

(c)     if the application is a second or subsequent application (after an earlier application under Article 78 of the Law was refused within the period of 30 days before the second or subsequent application is made) and both or all the applications are for a licence for the use of the vehicle as referred to in sub-paragraph (b), £71.80.”.

5        Motor Vehicles (Driving Licences) (Jersey) Order 2003 amended

In Schedule 3 to the Motor Vehicles (Driving Licences) (Jersey) Order 2003[8], for the second part of the table of fees, entitled Prescribed Test, there shall be substituted the following part –

 

“Prescribed test

Compulsory basic training course (and giving of compulsory basic training certificate if successful)

On road practical test other than –

(a)        in respect of category C and D vehicles; and

(b)        in respect of category A1, A and P vehicles, where the applicant is required to produce a compulsory basic training certificate

Part 2

miscellaneous

6        Motor Vehicle Registration (General Provisions) (Jersey) Order 1993

In the Motor Vehicle Registration (General Provisions (Jersey) Order 1993 –

(a)     in Article 1, before the definition “Directive” there shall be inserted the following definition –

“ ‘agricultural tractor’ means a motor vehicle which is –

(a)     not constructed itself to carry any load, other than water, fuel, accumulators and other equipment used for the purpose of propulsion, loose tools and loose equipment;

(b)     designed and used primarily for work in connection with agriculture; and

(c)     driven on a road only when proceeding to and from the site of such work and which when so driven hauls nothing more than land implements or an agricultural trailer;”;

(b)     in Schedule 2 –

(i)      in paragraph 1, after the words “a motor vehicle which is” there shall be inserted the words “an agricultural tractor or”,

(ii)      in paragraph 4(a), for the words “for mopeds,” there shall be substituted the words “for agricultural tractors, mopeds,”;

(c)     in paragraph 1 of Schedule 5, the definition “agricultural tractor” shall be deleted.

7        Motor Vehicles (Driving Licences) (Jersey) Order 2003

In Schedule 5 to the Motor Vehicles (Driving Licences) (Jersey) Order 2003 –

(a)     under the heading “ITALY (EU) JERSEY LICENCE” there shall be inserted, in the correct alphabetical sequence, the following entries –

 

“Category C1

Category C1”

 

“Category D1

Category D1 (only if proved driving test passed in D1 vehicle)”;

(b)     the heading “QUEBEC JERSEY LICENCE” and the entry under it shall be deleted.

8        Citation and commencement

This Order may be cited as the Transport and Technical Services (Driver and Vehicle Standards – 2010 Fees and Miscellaneous Provisions) (Jersey) Order 2009 and shall come into force on 1st January 2010.
