THE MINISTER FOR SOCIAL SECURITY, in pursuance of Articles 1(5), 11 and
51 of the Social Security (Jersey) Law 1974[1], orders as follows –
1 Interpretation
In this Order, the “Order” means
the Social Security (Contributions) (Jersey) Order 1975[2].
2 Paragraph
1 of Schedule 1 to the Order amended
In paragraph 1 of Schedule 1 to the Order, after sub-paragraph (2)
there shall be added the following sub-paragraphs –
“(3) In calculating a
person’s liability to pay Class 1 contributions for the purpose of a
deduction of the value of such contributions from the holiday pay component of
insolvency benefit under Article 26G(1) of the Law, sub-paragraph (1)
of this paragraph shall apply as if for sub-paragraph (1)(a) there were
substituted the words ‘(a) holiday pay;’.
(4) In sub-paragraph (3), ‘holiday
pay component of insolvency benefit’ means any such component as is
specified in paragraph (2)(c) or (d) of Article 26C of the Law.”.
3 Paragraph
2 of Schedule 1 to the Order amended
In paragraph 2 of Schedule 1 to the Order, after sub-paragraph (4)
there shall be added the following sub-paragraphs –
“(5) In calculating a
person’s liability to pay Class 1 contributions for the purpose of a
deduction of the value of such contributions from the notice pay component of
insolvency benefit under Article 26G(1) of the Law, sub-paragraph (1)
of this paragraph shall apply as if for sub-paragraph (1)(c) there were
substituted the words ‘(c) a payment in lieu of notice.’.
(6) In sub-paragraph (5), ‘notice pay
component of insolvency benefit’ means any such component as is specified
in paragraph (2)(a) of Article 26C of the Law.”.
4 Paragraph
14 of Schedule 1 to the Order amended
In paragraph 14 of Schedule 1 to the Order –
(a) for
the heading there shall be substituted the following heading –
“14 Transitional
arrangements”;
(b) for
the words “1st January 2013” there shall be substituted the
words “1st July 2013”.
5 Paragraph
5 of Schedule 2 to the Order amended
In paragraph 5 of Schedule 2 to the Order –
(a) for
the heading there shall be substituted the following heading –
“5 Transitional
arrangements”;
(b) for
the words “1st January 2013” there shall be substituted the
words “1st July 2013”.
6 Citation
and commencement
This Order may be cited as the Social Security
(Contributions) (Amendment No. 13) (Jersey) Order 2012 and
shall come into force on 1st January 2013.
