THE MINISTER FOR SOCIAL SECURITY makes this Order under Articles 3, 6, 10, 11 and 51 of the Social Security (Jersey) Law 1974 –

Part 1

Social Security (Classification) (Jersey) Order 1974 amended

1        Social Security (Classification) (Jersey) Order 1974 amended

This Part amends the Social Security (Classification) (Jersey) Order 1974.

2        Article 3 heading amended and new Article 3A inserted

(1)     In the heading to Article 3, at the end there is inserted “: Schedule 2”.

(2)     After Article 3 there is inserted –

“3A   Persons to be treated as employers: employment by 2 or more employers

(1)     This paragraph applies, in relation to a contribution month, where –

(a)     a person (“P”) is employed by 2 or more employers who carry on business in association;

(b)     the amount of P’s earnings, in respect of each of those employments, does not exceed the Class 1 minimum earnings threshold (but the total amount of P’s earnings from those employments does exceed the threshold); and

(c)     the employers agree that the person employed is to be treated as being employed by only one of them (the “nominated employer”).

(2)     For the purposes of the Law –

(a)     the nominated employer is to be treated as P’s employer; and

(b)     P’s earnings from all of the employments mentioned in paragraph (1) are treated as earnings paid in respect of the employment with the nominated employer.”.

3        Part 2 of Schedule 1 (persons treated as Class 2 insured persons) amended

In Part 2 of Schedule 1, the following paragraphs are deleted –

(a)     paragraph 8 in column (A) and paragraph 8 in column (B) (employment as a sub-postmaster);

(b)     paragraph 9 in column (A) and paragraph 9 in column (B) (employment for less than 8 hours a week);

(c)     paragraph 13 in column (A) and paragraph 13 in column (B) (employment as an interviewer).

Part 2

Other amendment, citation and commencement

4        Social Security (Contributions) (Jersey) Order 1975 amended

For Article 8(1A) (imprisonment or detention in legal custody) of the Social Security (Contributions) (Jersey) Order 1975, there is substituted –

“(1A) But paragraph (1) does not except a person from liability to pay a contribution for any month if –

(a)     in that month, the person undertakes paid work outside the prison or other place of detention as part of a programme of rehabilitation; and

(b)     the amount of the person’s earnings in that month is equal to or exceeds the Class 1 minimum earnings threshold.”.”

5        Citation and commencement

This Order may be cited as the Social Security (Classification and Contributions) (Amendment) (Jersey) Order 2021 and comes into force on 1st January 2022.
