MOTOR
VEHICLE REGISTRATION (GENERAL PROVISIONS) (AMENDMENT No. 9) (JERSEY) ORDER 2001

THE
HOME AFFAIRS COMMITTEE, in pursuance of Articles 4, 7, 8, 10 and 15 of the
Motor Vehicle Registration (Jersey) Law 1993,
as amended,
orders as follows -
1. In this Order,
“principal Order” means the Motor Vehicle Registration (General Provisions) (Jersey) Order 1993,
as amended.
2. For Article 1(1) of the principal Order
there shall be substituted the following paragraph -
“(1) In this Order, unless the context otherwise
requires -
‘the
Directive’ means the Directive of the Council of the European Communities of
6th February 1970 on the approximation of the laws of the Member States
relating to the type-approval of motor vehicles and their trailers (Council
Directive 70/156/EEC), as amended;
‘the
Law’ means the Motor Vehicle Registration (Jersey)
Law 1993, as amended.”.
3. In Article 5(b)(iii) of the principal
Order, for the amount “£18.50” there shall be substituted the amount “£18.95”.
4. In Article 21 of the principal Order -
(a) in paragraphs (1)(c), (2)(c) and (4)(b),
for the amount “£60.50” in each place where it occurs there shall be
substituted the amount “£62”;
(b) in paragraph (3)(c), for the amount “£42”
there shall be substituted the amount “£43.05”.
5. In Article 23(b) of
the principal Order, for the amount “£23.50” there shall be substituted the
amount “£24.05”.
6.-(1) In
the Second Schedule to the principal Order, for paragraph 1(a) there shall be
substituted the following sub-paragraphs -
“(a) evidence satisfactory to the Inspector that the vehicle conforms
to the relevant type approval legislation of the United Kingdom;
(aa) (where the vehicle was manufactured in a Member State of the
European Union other than the United Kingdom) a certificate of conformity issued
pursuant to the Directive, the effect of which is to state that the vehicle can
be permanently registered without further approvals in Member States having
left-hand traffic and using imperial units of measurement for the purposes of
calculating speed and distance; or
(ab) (where the vehicle was manufactured in a Member State of the
European Union other than the United Kingdom, but it is not a vehicle in
respect of which such a certificate of conformity has been issued) evidence
satisfactory to the Inspector that the vehicle conforms to the relevant whole
vehicle national type approval legislation of that State in accordance with the
Directive, and -
(i) that the vehicle complies with the
relevant provisions of the Motor Vehicles (Construction and Use) (Jersey) Order
1998, as amended, and the Road Traffic (Lighting) (Jersey) Order 1998, or
(ii) that to the extent that it does not comply
with those provisions of those Orders, a licence has been granted under Article
39A of the Road Traffic (Jersey) Law 1956, as amended, providing that they
shall not apply to that vehicle or that they shall apply subject to specified
modifications, and the vehicle complies with the terms of that licence;”.
(2) In the Second Schedule to the principal Order -
(a) in paragraph 2 the words “clause (1) of” shall be deleted;
(b) in paragraph 3, for the words “clause (ii)
of sub-paragraph (a)” there shall be substituted the words “sub-paragraph
(ab)”.
(3) In the Second Schedule to the principal
Order -
(a) in paragraph 4(a), for the amount “£297”
there shall be substituted the amount “£304.40”;
(b) in paragraph 5, for the amount “£60.50”
there shall be substituted the amount “£62”;
(c) in paragraph 6(2), for the amount “£23.50”
there shall be substituted the amount “£24.05”.
7.-(1) This Order may be cited as the Motor Vehicle
Registration (General Provisions) (Amendment No. 9) (Jersey) Order 2001.
(2) Articles 1, 2, 6(1) and 6(2) of this Order, and this Article,
shall come into force on the seventh day after this Order is made.
(3) Except as provided in paragraph (2) of this Article, this Order
shall come into force on the first day of January 2002.
