Infrastructure (Driver and Vehicle Standards – 2022 Fees) (Jersey) Order 2021

THE MINISTER FOR INFRASTRUCTURE makes this Order under Articles 8, 29 and 46 of the Motor Traffic (Jersey) Law 1935, Articles 4, 7, 8, 10 and 16 of the Motor Vehicle Registration (Jersey) Law 1993, Articles 6, 7, 8, 77, 78 and 84 of the Road Traffic (Jersey) Law 1956 –

1        Motor Traffic (Public Service Vehicles) (Fees) (Jersey) Order 2008 amended

In Article 2 of the Motor Traffic (Public Service Vehicles) (Fees) (Jersey) Order 2008 –

(a)     for paragraphs (1) and (2) there is substituted –

“(1)    The fee for examination of a vehicle for a certificate of fitness under Article 8 of the Law is £164.00.

(2)     The fee for re-examination of a vehicle for a certificate of fitness under Article 8 of the Law, following a failure to pass an earlier examination, is £82.00.”;

(b)     in paragraph (5) for sub-paragraphs (b) to (d) there is substituted –

“(b)    in the case of a cab, if the applicant for the badge is required to pass a driving assessment test to satisfy the Inspector that the applicant is capable of safely driving a vehicle of that type, £103.50;

(c)     in the case of a cab, if the applicant for the badge is required to pass a knowledge test to satisfy the Inspector that the applicant has an adequate knowledge of Jersey, £82.00;

(d)     in the case of a char-à-banc, if the applicant for the badge is required to pass a knowledge test to satisfy the Inspector that the applicant has an adequate knowledge of Jersey, £55.00.”.

2        Motor Vehicle Registration (General Provisions) (Jersey) Order 1993 amended

In the Motor Vehicle Registration (General Provisions) (Jersey) Order 1993, in a provision listed in column 1 of the following table, for the figure specified in column 2 there is substituted the figure specified in column 3 –

3        Motor Cars (Driving Instruction) (Jersey) Order 1982 amended

For Article 7 of the Motor Cars (Driving Instruction) (Jersey) Order 1982 there is substituted –

“7      Fees

(1)     A person applying to submit himself or herself to the written part of the examination must pay a fee of £106.50.

(2)     A person applying to submit himself or herself to the practical part of the examination must pay a fee of £106.50.

(3)     The fee to be paid by a person who applies for the retention of his or her name in the register for a further period of 4 years is £215.00.

(4)     The fee to be paid by a person who applies for the entry of his or her name in the register is £215.00.”.

4        Motor Vehicles (Construction and Use) (Jersey) Order 1998 amended

In the Motor Vehicles (Construction and Use) (Jersey) Order 1998 –

(a)     for Article 2(7) there is substituted –

“(7)    For the purposes of Article 78(3) of the Law, the fee to accompany an application for a licence authorising the use of a vehicle not complying with Orders under Article 77 of the Law is –

(a)     if the application is for a licence for the use of the vehicle on a specified journey or for a specified purpose or for a period of not more than 12 months, £105.50;

(b)     if the application is for a licence for the use of the vehicle in any other case, £192;

(c)     if the application is a second or subsequent application (after an earlier application under Article 78 of the Law was refused within the period of 30 days before the second or subsequent application is made) and both or all the applications are for a licence for the use of the vehicle as referred to in sub-paragraph (b), £96.”;

(b)     in Article 120(1B) for “£188” there is substituted “£192”.

5        Motor Vehicles (Driving Licences) (Jersey) Order 2003 amended

In Schedule 3 to the Motor Vehicles (Driving Licences) (Jersey) Order 2003, for the second part of the table of fees, entitled “Prescribed Test”, there is substituted –

 

“Prescribed test

Compulsory basic training course (and giving of compulsory basic training certificate if successful)

£134.50

Duplicate copy of compulsory basic training certificate

Off road theory test other than in respect of category C and D vehicles

£37.50

Off road theory test in respect of category C and D vehicles

On road practical test other than in respect of category A1, P, C and D vehicles or, in respect of category A, where a person is not required under Article 24(4)(e) to produce a compulsory basic training certificate to the examiner immediately before taking the test

On road practical test in respect of category A1 and P vehicles or, in respect of category A, where a person is required under Article 24(4)(e) to produce a compulsory basic training certificate to the examiner immediately before taking the test

6        Citation and commencement

This Order may be cited as the Infrastructure (Driver and Vehicle Standards – 2022 Fees) (Jersey) Order 2021 and comes into force 1st January 2022.
