at Work (Lifts) (Jersey) Regulations 1990[1]
1 Interpretation
In
these Regulations –
“gates” means
the door or other devices which are designed to close either automatically or
manually to prevent access by persons or other loads to a lift or a liftway;
“guides” means
the components of a lift or a service lift which provide guiding for the lift
car sling or counterweight;
“lift” means
an item of permanent lifting equipment serving defined landing levels
comprising a lift car and running at least partially between rigid vertical
guides or guides whose inclination to the vertical is less than 15 degrees;
“lift car”
means the part of the lift which carries passengers or other loads;
“liftway”
means the space in which the lift car and the counterweight, if any, travel;
“maintained”
means maintained in an efficient state, in efficient working order and in good
repair;
“passenger lift”
means a lift comprising a lift car whose dimensions clearly permit the access
of persons;
“safe working load”
means the maximum working load which can safely be carried by a lift as
required to be specified in the latest examination certificate obtained under Regulation
4;
“service lift”
means a lift comprising a lift car the interior of which is inaccessible to
persons by reason of its means of construction and which has internal
dimensions not exceeding 1.25 square metres of floor area, a depth, a height
and a width of 1.4 metres;
“sling” means
the framework carrying the lift car or counterweight, connected to the means of
suspension or support, whether or not integral with the lift car enclosure.
2 Application of these Regulations
These Regulations apply
to all non-domestic premises.
3 Construction and maintenance
Every lift shall be of
good mechanical construction, sound material and adequate strength, and shall
be properly maintained.
4 Examinations
and reports
(1) Every
lift shall be thoroughly examined by a competent person at least once in every period
of 6 months.
(2) Every
lift which is installed on or after the date on which these Regulations come
into force shall be thoroughly tested and examined by a competent person before
being brought into use.
(3) Every
lift which is altered, modified or repaired in such a way as is likely to
affect its safe operation shall be thoroughly tested and examined by a
competent person before being brought into operation after such alteration,
modification or repair.
(4) The
person making or responsible for carrying out an examination or test and
examination of any lift under this Regulation shall complete, with the
information thereby required, and sign, a certificate of the result of the
examination or test and examination in the certificate prescribed as Form 1 in
the Schedule and, in the case of a passenger lift, the certificate prescribed
as Form 2 in the Schedule and shall, within 28 days, send the certificate or
certificates, as the case may be, to the person having the duty to comply with
these Regulations as respects that lift.
(5) The
person having the duty to comply with these Regulations in respect of a lift
shall, for 2 years from the date on which it was signed, preserve and keep
readily available for examination by an inspector, the report of the result of
every examination and test and examination made in pursuance of paragraphs (1)
to (3) in respect of that lift.
(6) Where
the examination or test and examination shows that the lift cannot be used or
continue to be used with safety unless certain alterations, modifications or
repairs are carried out immediately or within a specified time, the person
making the report shall within 28 days of the completion of the examination
also send a copy of the report to an inspector.
(7) The
Minister may, from time to time, by Order, amend the Schedule.
5 Display of certificates
The person having the
duty to comply with these Regulations in respect of a passenger lift shall
cause a copy of the last certificate in Form 2 in the Schedule to be displayed
at all times in a prominent place inside the lift car to which it relates.
6 Enclosures and gates
(1) Every
liftway shall be efficiently protected by a substantial enclosure and fitted
with gates, and the enclosure shall be such as to prevent, when the gates are
shut, any person falling down the liftway or coming into contact with any
moving part of the lift.
(2) Any
such gate shall be fitted with efficient interlocking or other devices to
secure that the gate cannot be opened except when the lift car is at the
landing and that the lift car cannot be moved away from the landing until the
gate is closed.
(3) Every
lift and every such enclosure as is mentioned in paragraph (1) shall be so
constructed as to prevent any part of any person or any goods carried in the
lift being trapped between any part of the lift and any fixed structure or
between the counterweight and any other moving part of the lift.
7 Safe working load
(1) There
shall be marked conspicuously on every lift the maximum safe working load, and,
in the case of a passenger lift, the maximum number of passengers which the
lift can safely carry at any one time.
(2) No
load greater than the safe working load shall be carried on any lift except for
the purposes of a test carried out in pursuance of Regulation 4(2) or (3).
8 Additional safety requirements
The following additional
requirements shall apply to passenger lifts to which these Regulations
apply –
(a) efficient
devices shall be provided and maintained to prevent the lift car overrunning;
(b) every
lift car shall on each side from which access is afforded to a landing be
fitted with a gate, and in connection with every such gate efficient devices
shall be provided to secure that, when persons or goods are in the lift car,
the lift car cannot be raised or lowered unless the gate is closed, and will
come to rest when the gate is opened;
(c) there
shall be provided and maintained in the interior of every lift car an easily
recognizable and accessible emergency alarm device, suitable for calling
outside assistance, in the form of a bell, intercom, external telephone or
similar device; and
(d) there
shall be provided and maintained efficient devices which will support the lift
car together with its safe working load in the event of failure or breakage of
the ropes, chains, hydraulic or other lifting device, mechanism or apparatus.
9 Exemptions
The Minister may (subject
to such conditions, if any, as may be specified therein) by certificate in
writing (which may at the Minister’s discretion be revoked at any time)
exempt from all or any of the requirements of these Regulations –
(a) any
particular plant or equipment or any class or description of plant or
equipment; or
(b) any
particular work or class of work,
if the Minister is satisfied
that the requirements in respect of which the exemption is granted are not
necessary for the protection of persons employed or are not reasonably
practicable.
10 Citation
These Regulations may be
cited as the Health and Safety at Work (Lifts) (Jersey) Regulations 1990.
