Control of Housing and Work (Temporary Exemption) (Jersey) Order 2021

THE CHIEF MINISTER makes this Order under Article 27(3) of the Control of Housing and Work (Jersey) Law 2012 –

1        Interpretation

(1)     In this Order –

first undertaking” means an undertaking which holds a business licence that permits it to employ a specified number of persons with Licensed or Registered status;

second undertaking”, in relation to a person, means an undertaking which is not the undertaking under whose business licence the person is employed.

(2)     This Order is made without prejudice to the provisions of the Control of Housing and Work (Exemptions) (Jersey) Order 2013.

2        Meaning of “eligible worker

A person is an eligible worker if –

(a)     the person has Licensed or Registered status, and holds a valid registration card to that effect;

(b)     the person is employed by a first undertaking under its business licence; and

(c)     the person works an average of no less than one hour per week for that first undertaking.

3        Eligible worker to be disregarded for purposes of conditions on business licence

(1)     An eligible worker may be employed by a second undertaking.

(2)     In relation to that second undertaking, for the purposes of complying with a condition under Article 27(1)(a) of the Control of Housing and Work (Jersey) Law 2012 concerning the maximum number of individuals with Licensed or Registered status who are permitted to work in or for that second undertaking, the eligible worker is disregarded.

4        Duty of second or subsequent undertaking

A second undertaking which employs an eligible worker must take reasonable steps to ensure that, for the duration of that eligible worker’s employment with the second undertaking, that eligible worker continues to work for the first undertaking for an average of no less than one hour per week.

5        Citation, commencement and expiry

(1)     This Order may be cited as the Control of Housing and Work (Temporary Exemption) (Jersey) Order 2021 and comes into force 7 days after it is made.

(2)     This Order expires at the end of 31 December 2025.[1]
