Road Traffic (St. Saviour) (Jersey) Order 2000

THE ENVIRONMENT AND PUBLIC SERVICES COMMITTEE, in pursuance of Articles 62 and 84 of the Road Traffic (Jersey) Law 1956 and after consultation with the Connétable of St. Saviour, orders as follows –

PART 1

INTRODUCTORY

1        Application

This Order applies to the roads in the parish of St. Saviour.

2        Interpretation

(1)     In this Order –

Connétable” means the Connétable of St. Saviour;

Motor Traffic Law” means the Motor Traffic (Jersey) Law 1935;

road” includes part of a road.[1]

(2)     Unless the context otherwise requires, a reference in this Order to an enactment (including an enactment of the United Kingdom) is a reference to that enactment as amended from time to time and includes a reference to that enactment as extended or applied under another enactment.

PART 2

TRAFFIC CIRCULATION

3        One-way traffic

(1)     A vehicle must not be driven on a road specified in column 1 of Part 1 of Schedule 1 except in the direction specified opposite that road in column 2 of that Part.[2]

(2)     Unless it is a char-à-banc in the course of providing a service that consists of carrying students to or from school, a char-à-banc must not be driven on a road specified in column 1 of Part 2 of Schedule 1 except in the direction specified opposite that road in column 2 of that Part.[3]

(3)     A vehicle with a width that exceeds 6 feet 6 inches must not be driven on a road specified in column 1 of Part 3 of Schedule 1 except in the direction specified opposite that road in column 2 of that Part.[4]

(4)     Paragraph 3 does not apply to –

(a)     a vehicle engaged in mechanical road sweeping or gulley emptying;

(b)     an omnibus in the course of providing a service authorised by an omnibus service licence granted under Article 19 of the Motor Traffic Law;

(c)     a vehicle being used for fire brigade, ambulance, police or other emergency purposes;

(d)     a char-à-banc in the course of providing a service that consists of carrying students to or from school.[5]

4        Prohibition or restriction of turns

(1)     A vehicle must not be driven from a road specified in column 1 of Part 1 of Schedule 2 onto a road specified opposite that road in column 2 of that Part.[6]

(2)     A vehicle must not be driven so as to make a right-hand turn from a road specified in column 1 of Part 2 of Schedule 2 onto a road specified opposite that road in column 2 of that Part.[7]

(3)     A vehicle must not be driven so as to make a left-hand turn from a road specified in column 1 of Part 3 of Schedule 2 onto a road specified opposite that road in column 2 of that Part.[8]

5        Prohibition of waiting and stopping

(1)     A vehicle must not wait on a road specified in columns 1 and 2 of Part 1 of Schedule 3.[9]

(2)     A vehicle must not wait on a road within 10 yards of its junction with another road.[10]

(3)     A vehicle must not stop on a part of a road that is authorised under Article 37 of the Motor Traffic Law as a stand for public service vehicles unless it is a public service vehicle of the appropriate class.[11]

(4)     A vehicle must not wait on a part of a road that has been designated by the Connétable as a no waiting area for the purpose of allowing access to premises from that part of that road.[12]

(5)     A vehicle must not wait on a part of a road that has been set aside for the delivery or collection of goods or merchandise unless it is a vehicle being used to deliver or collect goods or merchandise.[13]

(6)     A vehicle being used to deliver or collect goods or merchandise must not wait to be loaded or unloaded on a road specified in column 1 of Part 2 of Schedule 3 between the hours specified in column 2 of that Part.[14]

(7)     In this Article “waiting” does not include stopping a vehicle to set down or pick up passengers.

6        Waiting and stopping – savings[15]

Article 5 does not apply –

(a)     to a vehicle while it is being used for fire brigade, ambulance, police or other emergency purpose;

(b)     to a public service vehicle that is waiting on a part of a road that is authorised in accordance with Article 37 of the Motor Traffic Law as a stand for public service vehicles;

(c)     to a vehicle that is necessarily waiting on a road while there is being opened or closed a gate or other barrier at the entrance to premises to which the vehicle requires access or from which it has emerged;

(d)     to a vehicle that is waiting on a road on the express direction or with the specific permission of a police officer;

(e)     to a vehicle that has stopped on a road because it is prevented from proceeding by circumstances beyond its driver’s control;

(f)      to a vehicle that has stopped on a road to avoid an accident;

(g)     to a vehicle that is necessarily waiting on a road to enable it to be used in connection with –

(i)      a building operation or demolition work,

(ii)     the removal of an obstruction or potential obstruction to traffic,

(iii)     the maintenance, improvement or reconstruction of that road, or

(iv)    the erection, laying, placing, maintenance, testing, alteration, repair or removal of a structure, works or apparatus, in, on, under or over that road;

(h)     to a vehicle that is being used to deliver or collect postal packets as defined in Article 1 of the Postal Services (Jersey) Law 2004;

(i)      to a vehicle that is necessarily waiting on a road to enable it to be used to collect household refuse or to clean a cesspool.

6A     Roads closed to through traffic[16]

A vehicle must not be driven on a road specified in column 1 of Schedule 3A during the times prescribed in relation to that road in column 2 of that Schedule, except –

(a)     for the purpose of delivering or collecting a person or goods or merchandise to or from any premises situated on or adjacent to that road;

(b)     to or from a place on that road set aside under this Order for the parking of vehicles;

(c)     to or from premises having a means of vehicular access from that road;

(d)     a vehicle engaged in mechanical road sweeping or road gully cleaning; or

(e)     if the vehicle is a bicycle.

6B     Road closed to traffic when school open to children[17]

(1)     A person must not drive a vehicle on a road specified in column 1 of Schedule 3B during the times specified in relation to that road in column 2 of that Schedule unless –

(a)     the person reasonably requires vehicular access to premises situated on or adjacent to that road (within the meaning given in Article 62(2) of the Road Traffic (Jersey) Law 1956); or

(b)     the vehicle is –

(i)      driven by, or carrying, a person who is the holder of a disabled person’s badge,

(ii)      being used for fire brigade, ambulance, police or other emergency purposes, or

(iii)     a bicycle.

(2)     If a person is not prohibited by paragraph (1) from driving a vehicle on a road specified in column 1 of Schedule 3B, the restrictions specified in relation to the road in column 3 of that Schedule apply.

(3)     In paragraph (1)(b)(i) “disabled person’s badge” has the meaning given in Article 2 of the Road Traffic (Disabled Persons) (Badges for Motor Vehicles) (Jersey) Order 1982.

7        Driving and stationing of certain vehicles

(1)     A char-à-banc must not be driven on a road specified in columns 1 and 2 of Part 1 of Schedule 4 except with the written permission of the Connétable or on the express direction of a police officer.[18]

(2)     A char-à-banc must not be stationed on a road except with the written permission of the Connétable.[19]

(3)     A cab must not be stationed on a road except on the express direction of a police officer.[20]

(4)     Paragraph (3) does not apply to the stationing of a taxi-cab on a taxi rank as defined in the Motor Traffic (Cabs – General) (Jersey) Order 2021.[21]

(5)     A vehicle with a width that exceeds 6 feet 6 inches must not be driven on a road specified in columns 1 and 2 of Part 2 of Schedule 4 unless –

(a)     it is being used for fire brigade, ambulance, police or other emergency purpose;

(b)     it is being driven to or from premises situated on or adjacent to that road; or

(c)     it is a vehicle engaged in refuse collection, mechanical road sweeping or road gully cleaning.[22]

(6)     In this Article, “cab” and “char-à-banc” have the same respective meanings as in the Motor Traffic Law.

PART 3

LIMIT ON PARKING

7A     Parking of vehicles displaying parking discs etc.[23]

(1)     A person must not park a vehicle on a road or part of a road listed in Schedule 6 –

(a)     without displaying a parking disc or a parking card in accordance with paragraph (3); and

(b)     in the case of a road listed –

(i)      in Part 1 of Schedule 6, for a period in excess of 1 hour between 7.00 a.m. and 6.00 p.m. on any day except Sunday,

(ii)      in Part 2 of Schedule 6, for a period in excess of 2 hours,

(iii)     in Part 3 of Schedule 6, at any time other than for a period not exceeding 2 hours between 9.00 a.m. and 3.00 p.m., or

(iv)     in Part 4 of Schedule 6, for a period in excess of 3 hours. [24]

(2)     A vehicle that has been parked on a road specified in Schedule 6 must not be parked in any part of the same road within one hour after the expiry of the period permitted under paragraph (1).[25]

(3)     When a vehicle is parked on a road specified in Schedule 6, a parking disc or parking card, indicating the time at which the vehicle arrived there, must be displayed against the internal face of the windscreen of the vehicle, or, if the vehicle has no windscreen, at a convenient place on the left or near side of the vehicle, in such a manner that the arrival time of the vehicle may be distinctly seen by any person outside the vehicle.[26]

(4)     When a vehicle is parked on a road specified in Schedule 6, a person must not –

(a)     display more than one parking disc or parking card on the vehicle;

(b)     indicate on the parking disc or parking card a time different from that at which the vehicle was parked;

(c)     alter the time of arrival indicated on a parking disc whilst the vehicle is parked on that road.[27]

(5)     In this Article –

“parking” means leaving a vehicle, whether attended or unattended, between the hours of 8.00 a.m. and 5.30 p.m. on any day other than a Sunday, and includes stopping a vehicle to load or unload goods or merchandise, but does not include stopping a vehicle to set down or pick up passengers;

“parking card” means a device of a type and design approved by the Minister under Article 64 of the Road Traffic (Jersey) Law 1956;

“parking disc” means a parking disc of the kind described in Article 19 of the Road Traffic (St. Helier) (Jersey) Order 1996 or Article 18 of the Road Traffic (St. Lawrence) (Jersey) Order 1990.[28]

8        Duration of parking on certain roads[29]

A vehicle must not be parked on a road specified in Schedule 5 for a total period exceeding 12 hours in any continuous period of 24 hours.

8A     Parking of motor cycles and mopeds[30]

(1)     A road specified in Schedule 7 is designated as a parking place at which only a motor cycle or moped may park.

(2)     A motor cycle or moped that has parked on a road specified in Schedule 7 must not return to park on that road within 24 hours of its departure.

(3)     A motor cycle or moped must not be parked on a road specified in Schedule 7 for a total continuous period of more than 7 days.
